Clear mechanism for exploiting railway infrastructure assets

Decree 15 on management, use and exploitation of railway infrastructure assets clearly stipulates the mechanism for leasing, transferring, and expanding investment, creating favorable conditions for businesses.


Decree 15/2025-ND-CP of the Government regulating the management, use and exploitation of railway infrastructure assets, which has just been issued, has many clear provisions on mechanisms, aiming to facilitate the effective exploitation of national and urban railway infrastructure assets.

According to the Ministry of Finance, the previous Decree No. 46/2018/ND-CP on management, use and exploitation of national railway infrastructure assets only regulated national railways, not urban railways; did not cover all types of railway infrastructure assets invested and managed by the State or did not clarify the management, use and exploitation regime for some cases.

Decree 15 clearly stipulates these contents. Accordingly, all existing national railway infrastructure assets are assigned to national railway asset management enterprises in the form of excluding the State capital component in the enterprise.

All existing urban railway infrastructure assets (except assets assigned to enterprises for management under the form of calculating the state capital component at the enterprise) are assigned to enterprises for management of urban railway assets under the form of not calculating the state capital component at the enterprise.

Regarding the exploitation method, railway asset management enterprises directly organize the exploitation of railway infrastructure assets through providing asset-related services and other services to organizations and individuals.

Through the railway asset management enterprise, the State leases the right to exploit the assets. The lessee provides services related to railway infrastructure assets and other services.

The State also transfers the right to exploit assets through the asset management enterprise for a limited period of time. Accordingly, the right to exploit existing assets, associated with investment in upgrading and expanding projects approved by competent agencies and persons, is transferred to another enterprise for a certain period of time under a contract. The enterprise receiving the transfer shall provide services related to the assets and other services as prescribed.

From there, revenue sources from asset exploitation are formed, including: Fees according to the provisions of the law on fees and charges; Revenue from providing services using railway infrastructure and other services; Revenue from leasing exploitation rights, transferring asset exploitation rights for a limited period; Other revenues.

The Decree also stipulates the services that national railway asset management enterprises directly organize and exploit through the provision of related services, including: Railway transport operation services; Goods preservation, warehousing and storage services; Waiting room and official accommodation services; Repair, maintenance, inspection and adjustment services for railway transport vehicles and equipment; Services for exploiting locations and locations of railway infrastructure; Services for exploiting railway signal and telecommunications infrastructure; Services for exploiting railway infrastructure for tourism, cultural and sports activities; Other services related to the exploitation of railway infrastructure according to the provisions of law.

For the method of leasing the right to exploit assets, the method of transferring the right to exploit assets for a limited period, a project must be prepared and approved by the Minister of Transport. The method is implemented through auction.

In addition, national railway infrastructure assets are also used to participate in investment projects under the public-private partnership method, in order to promote the efficiency of asset exploitation.
