This afternoon, June 12, Standing Vice Chairman of the Provincial People's Committee Ha Sy Dong chaired a meeting with departments, branches and localities to resolve problems regarding determining the starting price for auctioning land use rights, calculating land rental prices and land allocation progress for the Quang Tri Airport project.

According to the report of the Provincial Construction Investment Project Management Board, the unit is coordinating with Gio Linh district to speed up the progress of handing over the clean site to the investor of the Quang Tri Airport project, about 160 hectares, by the end of June 2024. Currently, the investor is completing procedures to lease land according to legal regulations.
However, the leaders of the Department of Natural Resources and Environment said that according to the 2013 Land Law, which is still in effect, only land lease is regulated according to the project, not according to the progress of site clearance or investment phases. Meanwhile, the 2024 Land Law has not yet come into effect, leading to difficulties in land lease and difficulty in ensuring the progress of project commencement as planned.
Regarding this issue, Standing Vice Chairman of the Provincial People's Committee Ha Sy Dong said that the current problem is that the procedures for land lease and land allocation to investors must comply with the 2013 Land Law and the Law on Investment under the Public-Private Partnership (PPP) method. Currently, the 2013 Land Law and the Law on Investment under the Public-Private Partnership method do not stipulate land lease according to site clearance progress or investment phases, but the law does not prohibit it, while the 2024 Land Law has not yet come into effect.
Therefore, the Department of Natural Resources and Environment continues to review and base on current land laws to advise the Provincial People's Committee on the form of land allocation according to the progress of site clearance or investment phases. From there, the Provincial People's Committee will report to the Provincial Party Committee Standing Committee for decision to speed up the project progress, in accordance with legal regulations. It is requested that the Provincial Construction Investment Project Management Board and Gio Linh District People's Committee continue to propagate and mobilize, speed up the progress of site clearance and handover to investors. In addition, complete the documents and procedures for land lease in the first phase in accordance with the process and regulations.
Regarding the construction of land price lists, functional departments and branches said that, in order to ensure the progress of many projects in the province, it is necessary to promptly remove obstacles in determining starting prices for auctioning land use rights and calculating land rental prices, especially during the transition period between the 2013 Land Law and the 2024 Land Law.
Currently, the Government is proposing that the National Assembly stipulate an earlier effective date for the 2024 Land Law, specifically August 1, 2024. Therefore, determining the starting price for auctioning land use rights and calculating land rental prices must comply with the 2024 Land Law.
Meanwhile, the 2024 Land Law stipulates that the determination of the starting price for auctioning land use rights must be applied according to specific land prices, but the current specific land price list of the province is lower than the market price because it was issued many years ago.
To resolve the above shortcomings, Standing Vice Chairman of the Provincial People's Committee Ha Sy Dong requested the Department of Natural Resources and Environment to re-draft a new specific land price list in accordance with market prices and submit it to the competent authority for promulgation, with completion date before August 2024.
Assign the Department of Finance to develop a calculation process according to coefficient K, following the new specific land price list to create consistency in implementation. During the legal transition period, for projects that have currently leased land but have not yet calculated the land rental price, urge investors to complete the documents to comply with legal regulations, to be completed before August 1, 2024.
