After the 2023 Housing Law, the 2023 Real Estate Business Law and the documents guiding the implementation of the law were issued, authorities at all levels and functional sectors promptly carried out propaganda and dissemination work to investors, relevant organizations and individuals. At the same time, they urgently and resolutely implemented solutions to remove obstacles and difficulties, promoting the safe, healthy and sustainable development of the real estate market.

The inspection and supervision of the implementation of housing policies and the real estate market have also been seriously organized and implemented. In particular, the Department of Construction regularly and effectively monitors the real estate market situation in the province, promptly taking appropriate measures and solutions to prevent the market from developing "hotly" or freezing, spreading rumors, speculating to inflate prices for profit, causing imbalances in supply and demand...

Therefore, despite the difficult economic conditions, in 2024, the People's Committees of districts, towns and cities in the province organized auctions of land use rights for projects according to the list approved by the Provincial People's Committee, ensuring the order and procedures according to regulations. A report from the Department of Construction shows that in 2024, localities organized auctions of 316 planning sites with an area of ​​130.84 hectares, collecting over 10.83 trillion VND (equal to 47.4% of the plan). This amount is assessed to be 2.4 times higher than in 2023. According to reports from localities, in the past year, there have been no cases of unusually high auction results, many times higher than the starting price. The winning auction price increased on average from 0.2% to 3% compared to the starting price. Thanh Hoa city and the districts of Thieu Hoa and Ha Trung are considered to be the localities with auction winning results increasing from 28.8% to 30% compared to the highest starting price.

According to the Department of Construction, land allocation and leasing through land use rights auctions have limited negative situations, contributed to supplementing a large source of revenue for the local budget and reinvested in infrastructure, serving the goal of socio-economic development. The organization of auctions is also carried out publicly, objectively, honestly, equally, ensuring the rights and legitimate interests of the participating parties in accordance with the provisions of law.

However, among the planned land auctioned in previous years, the occupancy rate (completed housing construction and occupancy) is still modest. Mr. Nguyen Manh Tuan, Head of the Department of Housing Management and Real Estate Market, Department of Construction, said that this rate in Thanh Hoa City is only about 20%. In districts and areas far from the urban center, this rate is only about 10%. This causes a huge waste of land resources.

There are many reasons for the above situation, partly due to people speculating, partly due to land that has won the auction but has not been granted a land use right certificate... However, according to the Head of the Department of Housing and Real Estate Market Management Nguyen Manh Tuan, the main reason is that the demand for budget revenue from land use right auctions is very large, while the demand of people to buy land for storage and profit is at a very high level. This is also part of the reason why land prices keep increasing, even in the same area, there are situations where the land planned later is auctioned at a higher price than the land planned before. This situation not only makes it difficult for the poor, low-income or middle-income people to access and buy residential land, but also makes it difficult for localities to attract large domestic and foreign corporations and enterprises to pay attention and research to invest in building projects and works.

Although real estate is a commodity and must follow market rules, it is a waste to not build houses on land that has been auctioned for a long time. To help prevent this situation, the 2023 Housing Law and the 2023 Real Estate Business Law (both effective from August 1, 2024) have set out regulations to control the time for construction of housing projects after winning the auction, along with sanctions. However, up to this point, there are still no specific regulations for the law to be put into practice.

Another good news for the real estate market in the land segment is that the Government is widely consulting and finalizing the implementation plan of Resolution No. 161/2024/QH15 dated November 23, 2024 of the National Assembly on continuing to improve the effectiveness and efficiency of implementing policies and laws on real estate market management and social housing development. Accordingly, it is expected that the Government will assign the People's Committees of provinces and centrally run cities to preside over and coordinate with ministries and branches to have appropriate solutions and thoroughly handle real estate projects facing difficulties, legal problems, and stagnation due to prolonged implementation and changes in the law over time; not "criminalizing" economic-civil relations... This solution is expected to "untie" many land projects to be reinvested, contributing to promoting the healthy and sustainable development of the real estate market.
