At a regular press conference held by the Ministry of Home Affairs this afternoon, June 16, Mr. Nguyen Tuan Ninh, Director of the Department of Civil Servants and Public Employees (Ministry of Home Affairs), said that the Ministry of Home Affairs has drafted a Decree regulating the encouragement and protection of dynamic, creative cadres who dare to think, dare to do, and dare to make breakthroughs for the common good.

The Ministry of Home Affairs has completed the draft Decree regulating the protection of cadres who dare to think, dare to do, and dare to take responsibility for the common good.

The drafting committee has organized to collect opinions from experts, scientists, managers, especially those specialized in law in the three regions on this content.

However, according to Mr. Ninh, this is a difficult, complicated, and sensitive issue, so the Department of Civil Servants and Public Employees continues to advise the ministry's leaders to issue a document to seek opinions from central ministries, departments, and branches, as well as from provinces and cities directly under the central government.

"Based on the synthesis of comments, we have completed the draft decree and submitted it to the Ministry of Justice for appraisal. The draft continues to be completed in the spirit of closely following the Party's policies, especially Conclusion 14-KL/TW of the Politburo on the policy of encouraging and protecting dynamic and creative cadres for the common good, meeting practical requirements. The comments show that ministries, branches and localities are very interested, many comments show high responsibility," said Mr. Ninh.

The draft Decree regulating the encouragement and protection of dynamic, creative, daring, and innovative cadres for the common good has been basically completed with 5 chapters and 27 articles. Of which, chapter 3 is very important, with the content of "policy to encourage measures to protect cadres, protect agencies, organizations, individuals, and handle violations".

The Head of the Department of Civil Servants and Public Employees shared: "To protect dynamic and creative cadres who dare to think and dare to do, they must be authorized by competent authorities, because if after the head of that agency gives permission, if any problem occurs, who will protect them? That is why we have proposed protecting the agencies and competent people who decide to allow the implementation of innovative proposals."

However, Mr. Ninh also said that there were some problems in the process of building the law. That is, in the incentive policy, there are some contents on upgrading ranks, planning for appointments beyond levels that are entangled with the Law on Civil Servants and Public Employees; the issue of protection when reducing criminal responsibility, being exempted... is entangled with the Criminal Law, the Law on Compensation for Damages.

"For the decree to come into effect, the entire political system, especially the judiciary, the prosecutor's office, and the court, must be involved. Therefore, we realize that there are contents in this decree that, if issued, will exceed the authority of the Government. We are currently advising the competent authority to advise the Government to assign the Ministry of Home Affairs to prepare a dossier to submit to the National Assembly session in the spirit of building a pilot resolution to protect officials who dare to think and dare to do," Mr. Ninh informed.

On the basis of the National Assembly issuing the pilot resolution, the ministry will propose to issue a decree for implementation, thus ensuring legality. The Ministry of Home Affairs is trying very hard and expects that if it keeps up with the steps, by the 6th session of the 15th National Assembly (October), if the National Assembly Standing Committee agrees and allows, it can submit the draft.

Regarding the information that the number of ministries and ministerial-level agencies will be reduced, Mr. Tran Van Khiem, Deputy Director of the Organization and Personnel Department (Ministry of Home Affairs), said that the structure of the 15th Government according to the National Assembly's resolution will remain the same as it is now. The reduction of ministries or any ministries must wait for the summary of 20 years of the Government structure.

Chief of Office of the Ministry of Home Affairs Vu Dang Minh added that this is a very complicated and sensitive issue, affecting the organizational structure of ministries and ministerial-level agencies in the Government structure, so it needs to be studied very carefully and must go through many rounds.

"The Ministry of Home Affairs has not yet made any proposal to the competent authority about merging this ministry or that ministry. Similar to before, the ministry has not proposed merging this province with that province, but only proposed merging districts and communes," Mr. Minh emphasized.
