New regulations on recruitment, promotion, and consideration of promotion of civil servants and public employees

The Circular clearly states regulations on recruitment of civil servants and public employees, civil servant promotion exams; regulations on recruitment of civil servants and public employees, civil servant promotion exams, and consideration of promotion of professional titles of civil servants.

In particular, the Council for recruitment of civil servants and public employees (recruitment examination, selection); Council for examination for promotion of civil servants; Council for consideration of promotion of professional titles of public employees (Council) is responsible for announcing the list and summoning candidates who meet the conditions, standards for taking the examination and information related to the organization of recruitment of civil servants and public employees, examination for promotion of civil servants according to the provisions of law on recruitment, management and use of civil servants and public employees.

At least 01 working day before the opening date, the Council is responsible for completing the following tasks:

Post the list of candidates by registration number, exam room, location map of exam rooms, rules, format, and time for each exam at the exam location.

The list of candidates called to the examination room includes at least the following information: full name, date of birth, personal identification code, agency, work unit (for civil servant promotion exams) and registration number. Each candidate has a unique registration number. The candidate's registration number consists of numbers and letters (if any) arranged in ascending and consecutive order; ensuring that no candidate has the same registration number.

Exam papers, question and answer data, scoring instructions, scoring sheets, forms, lists, documents for the exam. Cards of Council members, Supervisory Board, Council support departments, exam service departments. Facilities for organizing computer-based exams, interviews, oral questions, practice and office supplies for the exam.

Build test, questions and answers

Circular stipulating that exam papers, exam questions, scoring instructions, and answers for the recruitment of civil servants, public employees, and civil servant promotion exams that have not been used are classified as state secrets and will be declassified immediately after the exam is completed; scoring instructions and answers will be declassified after the exam is completed.

The construction of exam papers, exam questions, scoring instructions, and answers must be carried out in a safe, protected location with adequate storage, fire prevention, and fire fighting facilities, ensuring that no electronic information or data is received or transmitted between inside and outside the exam area.

Members participating in making exam papers, exam questions, scoring instructions, and answers for any exam must be isolated from the outside from the time they gather to make the exam papers until the end of that exam. If necessary and with the written consent of the Head of the Exam Committee, members are allowed to go out or contact the outside by landline or mobile phone; when talking, the speakerphone must be turned on, recorded, and under the supervision or witness of a member of the Supervisory Board and a representative of the police agency (if invited to participate).

The entire process of delivering, receiving, and transporting exam papers, exam questions, grading instructions, and answers must be supervised by members of the Supervisory Board and by representatives of the police agency (if invited to participate); bags containing exam papers, exam questions, grading instructions, and answers must be kept safe and secure during the delivery, receipt, and transport process.

Equipment at the test site (including damaged or unused equipment) may only be taken out of the isolation area after the final test is completed.

In addition, the Circular also clearly stipulates each form of exam organization: Exam organization on computer; exam organization on paper; interview, oral, practical, and project defense exams.

Candidates must be present at the examination room on time. Candidates who arrive late after the start time of the examination, section, or subject (exam) are allowed to take the exam in the following cases: No more than 5 minutes for exams with a maximum duration of 30 minutes or no more than 10 minutes for exams with a maximum duration of 60 minutes or more.

Handling violations of exam candidates

The Circular stipulates four forms of handling violations against candidates who violate exam rules and regulations: a-Reprimand; b-Warning; c-Suspension from the exam; d-Cancellation of exam results.

Reprimand shall be applied to candidates who violate the following rules: Not entering the correct position after being warned for the first time; communicating with another candidate and having been warned for the first time but not complying or reoffending.

A warning shall be applied to candidates who commit violations in one of the following cases: Having been reprimanded and re-offending; exchanging papers or scratch paper with other candidates; allowing other candidates to copy papers or copying papers from other candidates; using documents contrary to regulations; bringing into the examination room mobile phones, tape recorders, cameras, computers and other technical means of receiving, transmitting and transmitting information, means of backing up data, and other information storage and transmission devices (except where otherwise specified).

The form of suspension from the exam is applied to candidates who violate one of the following cases: Having been disciplined by warning but re-offending; using mobile phones, recorders, cameras, computers and other technical means of receiving, transmitting, backing up data, and other information storage and transmission devices during the exam (except in cases where otherwise prescribed); causing insecurity and disorder that affects the exam room.

Candidates who are suspended from taking any exam will have their exam results canceled and will not be allowed to continue taking the next exams (if any).

The form of cancellation of exam results shall be applied to candidates who violate one of the following cases: Writing or drawing content unrelated to the content of the exam on their own exam paper or another candidate's exam paper; committing one of the following acts: Swapping exam papers, doing another candidate's exam, letting another candidate do the exam for them; being suspended from the exam according to regulations.

Organization of review of promotion of professional titles of civil servants

The Circular clearly states the regulations on the organization of the review of professional title promotion for civil servants: Based on current regulations on standards and conditions for registration for review of professional title promotion for civil servants, the Chairman of the Council shall specifically decide on the method of organizing the appraisal of records, the Record Appraisal Form and forms serving the appraisal of records; must ensure accuracy, fairness, objectivity, science and compliance with the provisions of law.

Organization of appraisal of application files for promotion consideration

The members of the profile appraisal committee assigned to appraise the same profile will jointly appraise that profile. Based on the profile components and profile appraisal criteria, the profile appraisal committee will assess whether the profile meets the standards and conditions for consideration of promotion to the professional title of a civil servant and record the assessment results and related information (if any) in the Profile Appraisal Form.

When appraising the dossier, if the members of the appraisal committee do not agree on the appraisal results, the application and the appraisal results of the members shall be transferred to the Head of the appraisal committee for consideration and decision, or the Head of the appraisal committee shall synthesize and report to the Chairman of the Council for consideration and decision.

The appraisal results of each application are summarized in a general appraisal results summary table signed by the members participating in the appraisal of the application and the Head of the appraisal board.

The head of the appraisal board hands over the appraisal results of each application, the final summary of appraisal results is sealed in an intact envelope to the Council. When handing over and receiving, a handover record must be made, with the signatures of the handing over party, the receiving party, the Council representative, and the Supervisory Board representative.

Based on the number of applications for consideration, the nature of professional activities, standards and conditions for consideration of promotion to civil servant professional titles, the Council may directly appraise the applications according to the provisions of this Article without having to establish an Application Appraisal Board.

Decide on the promotion results

The Chairman of the Council organizes a Council meeting to review the promotion results; Council members exchange and discuss openly and democratically the promotion results; agree on the promotion results and the list of successful officials.

The Chairman of the Council reports to the head of the agency or unit organizing the review and approval of the results of the review and the list of successful civil servants according to regulations.

The determination of successful candidates in the promotion examination is carried out according to the provisions of Article 40 of Decree No. 115/2020/ND-CP, as amended in Clause 20, Article 1 of Decree No. 85/2023/ND-CP, and the regulations of the Ministry on management of professional titles of specialized civil servants.

This Circular takes effect from May 1, 2025. Circular No. 06/2020/TT-BNV dated December 2, 2020 of the Minister of Home Affairs promulgating the Circular promulgating the Regulations on organizing examinations and recruitment of civil servants and public employees, examinations for promotion of civil servants, examinations or consideration for promotion of professional titles of public employees; internal regulations on examinations and recruitment of civil servants and public employees, examinations for promotion of civil servants, examinations or consideration for promotion of professional titles of public employees.
