Specific regulations on forms of management of aviation infrastructure assets

The Ministry of Finance is seeking comments on a draft Decree regulating the management, use and exploitation of aviation infrastructure assets.


A notable point in the draft is that the management of aviation infrastructure assets will be assigned to businesses and organizations.

In particular, the draft stipulates that the enterprise ensuring flight operations shall manage technical infrastructure works ensuring flight operations in the form of state capital investment in the enterprise.

Technical infrastructure works to ensure flight operations will be assigned to flight operations assurance enterprises for management (Illustration photo).

The port enterprise is assigned to manage the works of airport infrastructure, including: runways, taxiways, aircraft parking lots and auxiliary works and areas of the airport; airport emergency works and fire prevention and fighting works in the airport; airport perimeter fence works, guard booths and internal traffic routes in the airport; technical infrastructure works for environmental protection in the airport; vehicle and ground equipment assembly area, fueling area for vehicles and ground equipment, and other works in the airport area.

These assets are assigned in a form that does not include the state capital component in the enterprise.

In addition, the draft Decree also assigns port enterprises to manage assets including: Works serving aviation security and airport emergency outside the airport; Airport fence works; internal and external port roads; power supply works; water supply and drainage works; lighting works; communication works;

Environmental protection technical infrastructure works outside the airport; Passenger terminal works, diplomatic guest houses, aviation logistics areas, cargo terminals, cargo warehouses with cargo gathering areas.

For these assets, the management assignment will be calculated based on the state capital component in the enterprise.

In particular, for aviation infrastructure assets related to national defense and security, after transferring assets to port enterprises, based on the needs and capabilities of asset management and exploitation, as well as the opinions of the Ministry of National Defense and the Ministry of Public Security, enterprises must develop a plan to invest additional state capital in the enterprise using the value of aviation infrastructure assets.

Then, submit to the competent authority or person for approval according to the provisions of law on management and use of state capital invested in production and business at enterprises.

The plan for additional investment in charter capital must specifically identify the list of aviation infrastructure assets to be transferred from the form of assignment without calculating the state capital component at the enterprise to the form of calculating the state capital component at the enterprise.

For aviation infrastructure assets, which are assets with established public ownership, they will be handled in the form of assignment or transfer to an asset management enterprise.

At that time, the authority and procedures for handing over and transferring assets shall be implemented in accordance with the provisions of law on handling assets with established public ownership, and it is not necessary to re-perform the asset handover procedures.

The Minister of Construction will decide on the assignment of aviation infrastructure assets under its management.

Based on accounting records, records of transfer of aviation infrastructure assets to the Ministry of Construction and actual management, the Ministry of Construction directs the review and inventory of all aviation infrastructure assets currently managed or temporarily managed by agencies, organizations, units and enterprises for classification.

Based on the results of the review, statistics and classification of assets, the aviation management agency prepares a set of documents requesting the transfer of aviation infrastructure assets to report to the Ministry of Construction.
