Pursuant to Article 111 and Article 112 of the 2019 Labor Code, the days off with full pay in January 2024 of cadres, civil servants, public employees and employees at non-state companies (private companies) are implemented as follows:

1. Holidays in January 2024 for officials, civil servants and public employees

In January 2024, cadres, civil servants and public employees will have a total of 08 days off per week, including: January 6, 07, 13, 14, 20, 21, 27, 28, 2024 (including 04 Saturdays and 04 Sundays).

In addition, according to Point a, Clause 1, Article 112 of the 2019 Labor Code, on the occasion of New Year 2024, cadres, civil servants and public employees will have 1 day off on Monday (January 1, 2024). (If the weekly day off in December 2023 is added, then this holiday will give cadres, civil servants and public employees 3 consecutive days off from December 30, 2023 to January 1, 2024 (including 1 day off for New Year 2024 and 2 weekly days off in December 2023)).

Thus, in January 2024, cadres, civil servants and public employees will have a total of 09 days off and receive full pay (08 weekly days off and 01 holiday).

1.1. Holidays in January 2024 for employees with 2 days off per week (Saturday and Sunday)

In January 2024, employees in this case will have the same number of weekly days off as the ministries, civil servants and public employees in Section 1, which is 09 days.

1.2. Holidays in January 2024 for employees with 1 day off per week (Sunday)

In January 2024, employees in this case will have a total of 05 days off. Specifically as follows:

(i) 04 Sundays, including: January 07, 14, 21, 28, 2024.

(ii) 01 day off for New Year's Day: January 1, 2024.

2. Will employees get a bonus on New Year's Eve 2024?

Article 104 of the 2019 Labor Code stipulates bonuses as follows:

Article 104. Rewards

1. Bonus is the amount of money or property or other forms that the employer rewards the employee based on the production and business results and the employee's level of work completion.

2. The bonus regulations are decided by the employer and publicly announced at the workplace after consulting with the employee representative organization at the workplace where there is an employee representative organization at the workplace.”

At the same time, Article 3 of Circular 10/2020/TT-BLDTBXH stipulates the content that must be included in the labor contract as follows:

" Article 3. Main contents of labor contract

The main contents that must be included in a labor contract according to Clause 1, Article 21 of the Labor Code are stipulated as follows:

... 5. Salary according to job or position, form of salary payment, salary payment period, salary allowance and other supplements are stipulated as follows:

... c) Other additional amounts as agreed by both parties are as follows:

... c2) Additional amounts that do not have a specific amount of money along with the salary agreed upon in the labor contract, paid regularly or irregularly in each pay period related to the work process and work performance of the employee.

For other regimes and benefits such as bonuses as prescribed in Article 104 of the Labor Code, initiative bonuses ; mid-shift meal allowances; allowances for gasoline, telephone, travel, housing, childcare, child care; support when a relative dies, a relative gets married, a birthday, allowances for employees facing difficult circumstances due to work-related accidents, occupational diseases and other allowances and subsidies , they are recorded as separate items in the labor contract .”

Accordingly, the law does not have any regulations requiring companies to pay bonuses to employees (including New Year bonuses). Instead, bonuses paid to employees will be based on one of the following documents:

- Bonus regulations are decided by the company and announced at the workplace.

- Labor contract signed between two parties.

- Collective labor agreement.

Normally, companies will pay bonuses when the company achieves high revenue and profits.

Thus , to know whether employees will receive a bonus on the occasion of New Year 2024 or not, employees need to find out the conditions for bonus payment in the company's bonus regulations, bonus terms in the labor contract or collective labor agreement.

In case the company and the employee have an agreement (or regulations) on the conditions and regulations for receiving Tet bonuses (New Year 2024) in the bonus regulations or labor contract, collective labor agreement and the employee has satisfied the conditions for receiving the bonus, the company must pay the bonus in accordance with the regulations.
