5th extraordinary session, 15th National Assembly: Review and approve the draft Land Law (amended)

At the 5th Extraordinary Session, the National Assembly will consider and approve 4 contents, including the draft Law on Land (amended) and the draft Law on Credit Institutions (amended).

According to the schedule, the 5th extraordinary session of the 15th National Assembly will open on January 15 and close on the morning of January 18 in the form of a concentrated meeting at the National Assembly House, Hanoi. The National Assembly will take a one-day break (January 17) for the agencies of the National Assembly, the Government and relevant agencies to absorb, revise and complete the draft laws and draft resolutions.

During 2.5 working days, the National Assembly will consider and approve 4 contents, including: (1) draft Land Law (amended); (2) draft Law on Credit Institutions (amended); (3) draft Resolution on a number of specific mechanisms and policies to remove difficulties and obstacles, speed up the implementation of National Target Programs (according to simplified procedures); (4) supplementing the Medium-term Public Investment Plan of central budget capital for the period 2021-2025 from the general reserve source corresponding to the increased central budget revenue in 2022 for public investment tasks and projects and supplementing the Medium-term Public Investment Plan for Vietnam Electricity Group from the reserve source of the Medium-term Public Investment Plan.

Regarding the draft Land Law (amended), after being received and revised, the draft Law submitted to the National Assembly at this extraordinary session consists of 16 chapters, 260 articles, 5 articles removed, 250 articles amended and supplemented (both in content and technique) compared to the draft Law submitted to the National Assembly at the 6th Session.

Regarding the major contents that require focused discussion at the 6th Session, based on research, discussion, exchange, and careful review, the relevant agencies have agreed to revise and complete the contents on: rights and obligations regarding land use of Vietnamese people residing abroad; not to expand the scope of receiving land use rights transfer of foreign-invested economic organizations; cases where foreign-invested economic organizations receive real estate project transfers according to the provisions of the law on real estate business; rights and obligations of economic organizations and public service units using land for annual rental payment for assets attached to land.

Along with that are: conditions for individuals not directly engaged in agricultural production who receive the transfer of rice-growing land; principles for establishing and approving land use planning at all levels; land use targets determined in the content of provincial and district-level land use planning; organization of implementation of land use planning and plans, allocation of provincial-level land use targets, district-level land use targets; land recovery for commercial housing projects, mixed housing and commercial and service projects; development, exploitation and management of land funds; the relationship between land recovery cases and agreements on receiving land use rights or having land use rights to implement socio-economic development projects not using state budget capital; types of land for implementing commercial housing projects through agreements on receiving land use rights or having land use rights.

In addition, the agencies also completed related contents: granting Certificates to households and individuals using land without documents on land use rights without violating land laws, not in cases where land was allocated without proper authority; land rent paid annually; content of land valuation methods and cases and conditions for applying each method; sea encroachment activities; subjects allowed to use national defense and security land in combination with labor production and economic construction activities; rights and obligations of military and police enterprises when using national defense and security land in combination with labor production and economic construction activities; no amendments or supplements to the Law on Public Investment.

Regarding the draft Law on Credit Institutions (amended), after being received and revised, the draft Law submitted to the National Assembly at the 5th Extraordinary Session consists of 15 chapters and 210 articles (compared to the draft Law submitted to the National Assembly at the 6th Session, 4 articles were removed, 11 articles were added, 15 articles were kept the same and other articles were technically revised). In particular, the opinions of National Assembly deputies on many contents were received: explanation of terms; policy banks; standards and conditions for managers, operators and some other positions of credit institutions, control boards; independent audit; operations of credit institutions; credit limits; finance, accounting, bookkeeping...

Some major issues of the draft Law reported to the National Assembly at the Session include: risk provision; early intervention in credit institutions and foreign bank branches; special control of credit institutions; handling cases of mass withdrawals, special loans and lending from credit institutions; handling of bad debts and secured assets; state management agencies; and implementation provisions.

The Draft Resolution on a number of specific mechanisms and policies to remove difficulties and obstacles, and accelerate the implementation of National Target Programs consists of 6 articles, stipulating a number of specific mechanisms and policies to remove difficulties and obstacles, and accelerate the implementation of National Target Programs, including: allocating and assigning annual central budget regular expenditure estimates; adjusting state budget estimates and annual capital investment plans of national target programs; promulgating regulations on procedures, criteria, and sample documents for selecting production development projects; using the state budget in cases where the owners of production development projects are assigned to purchase goods for production development activities.

In addition, there is the management and use of assets formed from production development support projects; entrusting self-balancing capital of local budgets through the social policy bank system; piloting decentralization mechanism to district level in managing and organizing the implementation of national target programs; assigning medium-term public investment plans, annual capital investment for small-scale construction investment projects with uncomplicated techniques, the State only supports investment in part of the cost, the rest is contributed by the people, with the participation of the people in supervision.

Regarding the fourth content, the draft Resolution of the National Assembly consists of 3 articles, regulating the use of the general reserve of the Medium-term Public Investment Plan for the period 2021-2025 and the allocation of reserve sources of the Medium-term Public Investment Plan for the period 2021-2025.

The opening and closing sessions of the 5th Extraordinary Session of the 15th National Assembly were broadcast live on Voice of Vietnam, Vietnam Television, and Vietnam National Assembly Television.

In addition, the National Assembly sessions discussing in the hall some new contents or different opinions of the draft Law on Land (amended) and the draft Law on Credit Institutions (amended) were broadcast live on Vietnam National Assembly Television.
