Prime Minister Pham Minh Chinh signed Decision No. 239/QD-TTg dated February 4, 2025 promulgating the Plan to implement the Law on People's Air Defense.
Law on People's Air Defense No. 49/2024/QH15 was passed by the 15th National Assembly at the 8th Session on November 27, 2024, effective from July 1, 2025. The Prime Minister issued the Plan for implementing the Law on People's Air Defense (PKND) with the aim of specifically defining the content of work, completion progress and responsibilities of relevant agencies and organizations in implementing the Law, ensuring timeliness, synchronization, unity, effectiveness and efficiency.
At the same time, determine the responsibilities and coordination mechanisms between ministries, ministerial-level agencies, government agencies and localities in carrying out activities to implement the Law nationwide and raise awareness and responsibility of Party committees, local authorities at all levels, agencies, organizations, enterprises and the entire population in implementing the Law.
The contents of the Plan include: Organizing propaganda, dissemination, legal education, and in-depth training on the Law on People's Public Security; organizing the review of current legal documents to propose amendments, supplements, abolition or issuance of new legal documents; developing legal documents detailing and guiding the implementation of the Law; organizing the inspection of the implementation of the Law and legal documents detailing the implementation of the Law.
According to the Plan, relevant authorities will review legal documents related to PKND and management of unmanned aircraft and other flying vehicles under their assigned state management authority; implement according to their authority or propose to competent authorities to promptly amend, supplement, replace, abolish or issue new legal documents to ensure compliance with the provisions of the Law and legal documents detailing and guiding their implementation.
The Ministry of National Defense shall preside over and coordinate with the Ministry of Justice and relevant ministries, branches and localities to develop and submit to the Government 2 Decrees before April 15, 2025, including: 1- Decree regulating the position, functions, tasks, organizational structure and operation of the People's Air Defense Steering Committees at all levels; the scope and height of air defense obstacles of air defense positions; policies and regimes for people mobilized to participate in air defense activities; 2- Decree regulating the management of unmanned aircraft and other flying vehicles.
At the same time, the Ministry of National Defense presides over and coordinates with relevant agencies and units to develop the following 5 Circulars: 1- Circular of the Minister of National Defense regulating the key points of air defense; composition and tasks of the advisory and support agencies for air defense commanders at all levels; organization of air defense forces; obstacle limitation surfaces in air defense battle areas; criteria for ensuring air defense safety for each type of weapon, equipment, and technical equipment of air defense battle areas; list of equipment for air defense forces; 2- Circular of the Minister of National Defense regulating the development of air defense plans; 3- Circular of the Minister of National Defense regulating the import and export of goods under the management of the Ministry of National Defense; 4- Circular promulgating technical standards and regulations for unmanned aircraft and other flying vehicles; 5- Circular of the Minister of National Defense promulgating documents on the content of training and professional training on PKND; content and program of PKND training; process and content of PKND drills.
The Ministry of Public Security presides over the development of the Circular of the Minister of Public Security detailing a number of articles of the Law on People's Public Security.
