The Law on People's Air Defense has stipulated the authority to grant flight permits for unmanned aircraft and other flying vehicles and cases exempted from granting flight permits.

This morning (November 27), with 100% (449/449) of National Assembly delegates present voting in favor, the National Assembly passed the Law on People's Air Defense.
The Law on People's Air Defense consists of 7 Chapters and 47 Articles, regulating principles, tasks, forces, and activities of people's air defense; management of unmanned aircraft and other flying vehicles and ensuring air defense safety; resources, regimes, policies, rights, obligations, and responsibilities of agencies, organizations, enterprises, and individuals regarding people's air defense.
National Assembly delegates pressed the button to pass the Law on People's Air Defense.
Prohibited acts include evading, opposing, obstructing the building, mobilization, operation and implementation of responsibilities to participate in the people's air defense force; mobilizing and using forces, weapons, means and works of the people's air defense against the provisions of law.
Taking advantage of or abusing the performance of people's air defense tasks to violate the law, infringe upon the interests of the State, the rights and legitimate interests of agencies, organizations, enterprises and individuals. Providing information, informing, filming, taking photos, measuring, drawing to reveal battlefield targets, plans, technical equipment, and combat works.
Gender discrimination in the performance of people's air defense work. Manufacturing, testing, production, repair, maintenance, trading, import, export, temporary import for re-export, temporary export for re-import, ownership, exploitation, use of unmanned aircraft, other flying vehicles; aircraft engines, aircraft propellers and equipment, devices of unmanned aircraft, other flying vehicles.
The law also stipulates that drones and other flying vehicles must be registered before being put into operation and use.
At the same time, registration conditions must meet technical standards and regulations issued or recognized by the Ministry of National Defense; have a certificate of technical standards from the manufacturer for goods manufactured in Vietnam.
For imported drones and other flying vehicles, full legal documents must be provided in accordance with the law when imported into Vietnam.
Management range at altitudes below 5,000m
Previously, presenting the Report on explanation, acceptance and revision of the draft Law on People's Air Defense, Chairman of the National Defense and Security Committee Le Tan Toi said that regarding the task of people's air defense, there were opinions suggesting adding regulations on the management scope of over 5,000m to ensure security, order and national defense in the locality;
Another opinion proposed to regulate people's air defense at altitudes below 3,000m because weapons equipped for people's air defense forces cannot destroy targets at altitudes above 5,000m.

The National Assembly Standing Committee believes that the draft Law stipulates that the people's air defense force participates in managing and protecting the airspace at an altitude of less than 5,000m based on the tasks, weapons, equipment, combat capabilities of the people's air defense force, and coordination with other forces in combat readiness, combat, and prevention of enemy air attacks.
Currently, the people's air defense force has been equipped with weapons with a range of over 5,000m; equipped with air defense reconnaissance means capable of observing and detecting targets at altitudes below 5,000m.
Therefore, the people's air defense force is capable of participating in managing and protecting the airspace at altitudes below 5,000m. Therefore, it is proposed that the National Assembly maintain the regulation on the management scope at altitudes below 5,000m.
Regarding the people's air defense command agency, there is a proposal to revise it as: "The Ministry of National Defense assists the Government in directing people's air defense as the standing agency of the Central People's Air Defense Command Committee, and military agencies at all levels are the standing agencies of the same-level people's air defense command committees in localities."
To ensure separation between the steering agency and the standing agency advising and assisting the People's Air Defense Steering Committee at all levels, the National Assembly Standing Committee has added the regulation: "The People's Air Defense Steering Committee is organized at the central, military region and local levels. The People's Air Defense Steering Committee at all levels has the task of advising and assisting the People's Air Defense Steering Committee at the corresponding level".
