A court in the city of Pavia, Italy, ruled in favor of a 75-year-old mother after she sued to have her 40- and 42-year-old sons removed from her home, CNN reported.
In the lawsuit, the mother described her two sons as “freeloaders,” living in the family home but not contributing financially or helping their mother. Both sons have jobs.
Judge Simona Caterbi decided to side with the retired mother, who was separated from the middle-aged father of two men. The 75-year-old mother spent her entire pension on food and home repairs without any help from her children.
The court ruled that her two sons have until December 18 to leave the house.
According to local newspaper La Provincia Pavese , the two men have hired lawyers to fight against their mother's forced departure from the home. They argue that Italian law stipulates that parents are obliged to care for their children when necessary.
"There is nothing in the law that provides an adult child with an unconditional right to remain in a home owned by his or her parents against their will and based solely on family ties," Judge Caterbi concluded.
The sons' lawyer told local media that his clients have not yet decided whether they will appeal.
