Hai Phong proposes preferential policies for businesses in industrial parks

According to the Hai Phong Department of Industry and Trade, the formation of industrial clusters (ICs) has brought about socio-economic efficiency, creating favorable conditions for access to land and production premises for small and medium-sized enterprises to invest in developing industrial production.

Up to now, the occupancy rate of industrial parks has been quite high, investment projects in industrial parks have promoted the economic and labor restructuring of localities towards increasing the proportion of industry, creating jobs and stable income for a part of the labor force in the area.

However, during the implementation process, Hai Phong city also encountered many problems, difficulties and obstacles. Some of these problems have been around for a long time but there are no effective policies or solutions to resolve them. The laws related to the management of industrial parks still have many overlapping and contradictory contents. Many issues arising in practice have no regulations to resolve.

From now until 2030, Hai Phong city will develop about 20 more industrial parks.

Specifically, the procedures for establishing industrial parks still have some difficulties and problems in applying legal regulations on investment and legal regulations on management and development of industrial parks.

Many industrial parks, although in accordance with relevant planning and having registered investors, cannot be established due to regulations on occupancy rates as stipulated in Decree No. 68 of the Government.

The planning of Hai Phong city for the period 2021-2030, with a vision to 2050, has been approved by the Prime Minister in Decision 1516. Accordingly, by 2030, the city will have 36 industrial parks with a total area of ​​about 1,600 hectares. Thus, from now until 2030, Hai Phong city will develop about 20 more industrial parks.

Recently, the Ministry of Industry and Trade advised the Government to issue Decree 32 on the management and development of industrial parks. Effective from May 1, 2024, this Decree has basically resolved the overlap of legal documents in the fields of land, investment, public investment, and construction related to industrial parks, creating favorable conditions for Hai Phong city to establish more industrial parks according to the industrial park development plan.

However, to achieve the goal of developing industrial parks according to the Hai Phong City Planning, the Hai Phong Department of Industry and Trade proposed that the Ministry of Industry and Trade soon submit to the Government for consideration and promulgation of the Law on Key Industries, the Law on Supporting Industries and issue a Circular guiding Decree 32/2024 on management and development of industrial parks.

Propose that the Government consider issuing incentive mechanisms and policies for enterprises investing in production and business in industrial parks (mainly domestic, small and medium-sized enterprises) similar to the incentives for enterprises investing in production and business in industrial parks. There is a support mechanism for existing industrial parks that cannot be transferred from investors to enterprises to complete, upgrade infrastructure and maintain the operation of the industrial park.

Coordinate with the Ministry of Planning and Investment to propose competent authorities to stipulate that investment projects to build technical infrastructure for industrial parks do not have to carry out investment policy approval procedures according to the provisions of the law on investment to reduce administrative procedures and speed up the progress of investment in building technical infrastructure for industrial parks.

With the above recommendations, the Ministry of Industry and Trade said it will closely coordinate with the Ministry of Planning and Investment in the process of proposing competent authorities to amend and perfect legal regulations on investment.

Regarding the proposal on preferential policies for enterprises in industrial parks, the Ministry of Industry and Trade said that Decree 32 has stipulated investment incentives for production and business investment projects in industrial parks and support for investment in building technical infrastructure of industrial parks.

Specifically, regarding investment incentives for investment projects in production and business in industrial parks, in Article 25 of Decree 32, the Government stipulates: Industrial parks are areas with difficult socio-economic conditions. The application of incentives for investment projects in production and business construction in industrial parks shall be implemented in accordance with the provisions of the law on land, the law on tax, the law on credit and other relevant provisions of law. In cases where the law stipulates incentive levels, the highest incentive level shall apply.

Regarding support for investment in building technical infrastructure for industrial parks, in Clause 1, Article 26 of Decree 32, the Government stipulates: local budgets (including targeted additional revenue from the central budget to local budgets) balance investment support and development of technical infrastructure systems inside and outside industrial parks in the area according to the provisions of the Law on Public Investment and the Law on State Budget...

Therefore, Hai Phong City shall base on the above regulations and related specialized laws, and actual local conditions to organize implementation according to regulations.
