3 projects are "hot spots"
On September 10, Mr. Tran Nam Hung, Vice Chairman of Quang Nam Provincial People's Committee, officially approved the adjustment of the implementation progress of three key projects of Bach Dat An Joint Stock Company, including Bach Dat Urban Area, Urban Area No. 7B expansion and Hera Complex Riverside Urban Area.
According to the new decision, compensation and site clearance for the remaining areas must be completed by June 2025. This is an important step to continue implementing the next procedures of the projects. It is expected that by December 2025, the projects must be fully completed, accepted and put into operation.
Bach Dat An Joint Stock Company is responsible for coordinating with Dien Ban Town People's Committee to review and evaluate the possibility of implementing compensation and site clearance. The investor also needs to propose a plan for the remaining area, especially for urban infrastructure and connecting traffic, and apply all necessary measures to completely resolve this issue.
In case the site clearance work cannot be continued or if the area is not within the scope of infrastructure investment, the company must assess the planning situation, prepare a proposal to adjust the detailed planning and report to the competent authority. The company also needs to develop a detailed plan on the progress of related work, including compensation, site clearance, resettlement, construction, financial mobilization and related procedures.
Enterprises must comply with legal regulations on construction, housing, real estate business and other relevant regulations. The company needs to closely coordinate with the People's Committee of Dien Ban town and relevant agencies to carry out necessary procedures and ensure progress.
Dien Ban Town People's Committee will urgently direct relevant departments and units to coordinate with the investor to resolve problems in compensation and site clearance, and at the same time urge the construction progress. If this work is not completed by June 2025, the town will review and propose appropriate solutions according to Plan No. 1892/KH-UBND.
The Department of Natural Resources and Environment is responsible for guiding and facilitating investors and the People's Committee of Dien Ban town in carrying out procedures related to land, and at the same time reviewing legal regulations to ensure proper implementation of current regulations and promptly reporting any arising problems.
This decision aims to ensure that projects are implemented on schedule, resolve outstanding issues, protect people's rights and promote the development of the new urban area in Dien Nam - Dien Ngoc. The relevant parties need to actively coordinate to complete the set goals.
The investor and the distributor have "sat down" together.
Previously, Nguoi Dua Tin reported that in 2017, Bach Dat An Company signed a contract with Hoang Nhat Nam Company to distribute about 1,000 land lots in three projects: Bach Dat Urban Area, Urban Area No. 7B expansion and Hera Complex Riverside Urban Area in Dien Ban town, Quang Nam province.
However, the two parties later had a dispute and had to go to court. The judgments had come into legal effect, but Bach Dat An Company did not execute the judgment as requested, despite being reminded many times by the enforcement agency. This violated the commitment on obligations and project implementation deadlines, seriously affecting the rights of nearly 1,000 customers.
Recently, Hoang Nhat Nam Company and Bach Dat An Company held a meeting to negotiate to resolve the dispute. The two sides discussed the use of the money that Hoang Nhat Nam Company collected from customers to fulfill the financial obligations of the projects, to complete the project and hand over the land and red books to customers.
The two companies have agreed on the land price for the assigned land and completed financial obligations at the Bach Dat Urban Area project.
Both parties commit to strictly implement the agreements reached in the meeting and recorded in the minutes. They also agree on the transfer of money and are legally responsible for their actions and work.
During a regular meeting in August to assess the socio-economic situation in the first 8 months of the year and discuss solutions for the following months, Mr. Le Van Dung, Chairman of the Quang Nam Provincial People's Committee, announced that after the province issued an "ultimatum" during the dialogue on July 17, the two companies have coordinated to fulfill their commitments.
Up to now, the four requirements set forth by the province have been basically fulfilled. Specifically, Bach Dat An Company has paid enough taxes to be re-issued its business license, transferred 15 billion VND to the People's Committee of Dien Ban town for compensation and site clearance, paid an environmental deposit, and carried out procedures to extend the project.
Mr. Le Van Dung said that the situation has shown signs of significant improvement, as households no longer register to receive people related to the project of Bach Dat An Company, showing that this "hot spot" has cooled down and has positive prospects.
