Giving opinions on the draft Law on Prevention and Combat of Human Trafficking (amended), delegate Lo Thi Viet Ha, Standing Member of the National Assembly's Social Committee, basically agreed on the necessity of amending the Law on Prevention and Combat of Human Trafficking.

The amended law aims to improve the law on preventing and combating human trafficking, the legal basis for supporting and protecting the legitimate rights and interests of victims and those in the process of being identified as victims, and to improve the effectiveness of state management on preventing and combating human trafficking.
Delegate Ha suggested that the Drafting Committee review to ensure the consistency of the draft Law with current laws such as the Penal Code, the Law on Legal Aid, etc. The delegate said that victims of human trafficking are mainly women and children, and the majority are from ethnic minority areas.

However, the draft Law still contains gender-neutral provisions, which do not clearly demonstrate the principle of ensuring gender equality in preventing and combating human trafficking. Delegates also suggested that the Drafting Committee study and add provisions on consulting on forms of human trafficking and support policies for women, especially women in ethnic minority and mountainous areas.
Delegate Ma Thi Thuy said that the draft Law on Prevention and Combat of Human Trafficking (amended) has been carefully researched and prepared by the drafting agency, the Ministry of Public Security, and fully supplemented with regulations to remove difficulties and shortcomings in the practical fight against human trafficking.
In particular, it has legalized the previous regulations guided in legal documents; added the scope of regulation as "People in the process of being identified as victims", regulations on the support regime for victims and people in the process of being identified as victims, including support for living, travel, psychological support, health care, employment, translation costs, legal aid, etc.
Along with that, the regulation "Prioritizing the application of science and technology in preventing and combating human trafficking" has been added; immigration management and information exchange to manage immigration activities... in line with the development trend of science, information technology and expanding international cooperation relations.
The delegate shared that in recent years, the Criminal Police Department of Tuyen Quang Provincial Police has coordinated with the Criminal Police Department of the Ministry of Public Security and the Blue Dragon organization to verify and rescue many victims of human trafficking returning from abroad and support the victims.

However, this is a non-governmental organization, and the current Law on Prevention and Combating Human Trafficking does not have any regulations on the organization and operation of this organization. It is recommended that specific regulations be considered to manage and create a legal basis for organizations involved in verifying and rescuing victims of human trafficking to comply with the provisions of law.
Regarding the Law on Juvenile Justice, delegate Ma Thi Thuy agreed with the promulgation of the Law to perfect judicial laws that are strict enough but also ensure humanity towards juvenile offenders; strengthen education, support, and help juvenile offenders to correct their mistakes...
Commenting on Article 27 on the Standing Agency assisting the National Council on Juvenile Justice, delegates suggested considering and reviewing the regulations to ensure consistency with relevant legal regulations. The proposal to assign the Ministry of Public Security would be more appropriate than assigning it to the Ministry of Labor, War Invalids and Social Affairs as in the draft.
Delegates also commented on specific provisions in Article 31 on Social Workers; Article 135 on separating criminal cases involving minors, and Article 153 on compensation for minors who are victims.
