(QNO) - This morning, January 2, at the Provincial Citizen Reception Office, the Provincial National Assembly Delegation (NAD) periodically received citizens in January 2024 under the chairmanship of delegates Duong Van Phuoc - Deputy Head of the Provincial NA Delegation and Dang Thi Bao Trinh - Deputy Secretary of the Provincial Youth Union.
At the meeting, Mr. Nguyen Tan Minh (An Bang block, Cam An ward, Hoi An city) and his authorized representative reported that in 2018, Hoi An city implemented the An Bang urban area project (sub-area 1) in Cam An ward. Mr. Minh's family has strictly complied with the handover of the entire area of 1,849.9m2 of annual crop land affected by the project.
At the time of land acquisition, Mr. Minh's family requested the People's Committee of Hoi An City to consider buying land and choosing a location to buy residential land when the agricultural land in the resettlement area of phase 1 of the project was acquired. The above wishes of his family were agreed to be resolved by the People's Committee of Hoi An City, expressed through the content of Official Dispatch No. 3151 dated August 29, 2017.
However, according to Mr. Minh, for nearly 5 years, after handing over the entire land plot of more than 1,849.9 square meters to the project, his family has not yet been allowed by the city government to buy a residential plot and be allowed to choose a location to buy residential land when the agricultural land in the project's resettlement area is reclaimed.
According to the investigation, previously, according to Official Dispatch No. 3706 dated July 19, 2017 of the Provincial People's Committee on resolving difficulties in recovering agricultural land in projects that are implementing site clearance work in Hoi An City and Official Dispatch No. 3151 dated August 29, 2017 of the Hoi An City People's Committee on allocating residential land with collection of agricultural land use fees in projects according to Official Dispatch No. 3706, his household had 1,849.9m2 of agricultural land recovered and was re-allocated 200m2 of residential land with collection of land use fees.
In Official Dispatch No. 913 dated April 24, 2023, Hoi An City People's Committee stated that on July 6, 2023, the Provincial People's Committee issued Official Dispatch No. 4374 on the cancellation of Official Dispatch No. 3706 dated July 19, 2017 of the Provincial People's Committee on resolving difficulties in recovering agricultural land in projects that are implementing site clearance work in Hoi An City. At the same time, the Provincial People's Committee has sent a written request to the Prime Minister for consideration and specific instructions.
In an exchange with Mr. Nguyen Tan Minh and his authorized representative, the representative of the Department of Natural Resources and Environment and the Provincial Inspectorate affirmed that the settlement of handing over 200m2 of residential land to Mr. Nguyen Tan Minh's household as stated in Official Dispatch 3706 dated July 19, 2017 of the Provincial People's Committee has no basis for consideration and settlement according to the provisions of the 2013 Land Law. The advisory body had to review and learn from the experience in advising on the issuance of this dispatch. Up to now, the Provincial People's Committee has not received any response from the Central Government.
Deputy Head of the Provincial National Assembly Delegation Duong Van Phuoc said that when the Provincial People's Committee issued Official Dispatch No. 3706 with the desire to resolve and ensure the rights of many cases of agricultural land revocation in Hoi An City.
Based on current legal regulations, there is no basis for resolution, but the Provincial Delegation of National Assembly Deputies has noted Mr. Minh's reflection and will include it in the 2024 monitoring plan to understand the issue clearly. On that basis, it is possible to propose a humane solution for Mr. Minh's case as well as similar cases, while clearly demonstrating the responsibility of the elected body to the citizens.
