The Government has just issued Decree No. 29 stipulating standards for titles of civil servants in leadership and management positions in state administrative agencies.
The Decree stipulates general standards applicable to leadership and management positions of civil servants, including: Standards on political ideology; standards on ethics, lifestyle, sense of organization and discipline; standards on qualifications; standards on capacity and prestige; standards on health, age, and work experience.
The Decree also specifies standards for each position of leadership and management civil servant of ministries, general departments and specialized agencies under provincial and district People's Committees.
Deputy Minister must have objective and comprehensive viewpoint.
It clearly states that the position of deputy minister is the deputy of the minister, head of a ministerial-level agency, assisting the minister in leading, directing, and managing one or several sectors, fields, and specialized areas of work as assigned by the minister; responsible to the minister and before the law for assigned duties and tasks.
Deputy Ministers must meet the general standards applicable to leadership and management positions. In addition, Deputy Ministers must have an objective, comprehensive, and dialectical perspective; have a deep understanding of the law, state management of the industry, management field, and international practices.
This position must also have the capacity to: Advise on strategic planning for industry and sector development; direct the development and effective implementation of legal documents, topics, projects, programs, and annual and term work plans of the industry and sector; direct or directly resolve difficult and complicated issues in the industry and sector.
The Deputy Minister is also required to have the capacity to direct the implementation of administrative reform, public service and civil servant regimes; direct the implementation of inspections, checks and handling according to the provisions of law; direct the settlement of recommendations, complaints and denunciations of organizations and citizens under his authority; coordinate between ministries, branches and between the central and local levels to synchronously, uniformly and effectively implement the Party's guidelines, policies and laws.
Some special cases apply title standards when appointing
The Decree also stipulates a number of special cases where the title standards are applied when appointing. Specifically, in the case of appointing personnel from outside sources, it is not necessary to ensure the standards of having experienced the position, leadership title, or management position at a direct subordinate position at the agency, organization, or unit expected to be appointed.
In case a deputy minister or deputy head of a ministerial-level agency is appointed to hold an equivalent position or title or to hold another position or title concurrently, it is not necessary to fully meet the standards of the equivalent or concurrent position or title.
In case of working in the armed forces, public service units, state-owned enterprises or other agencies and organizations in the political system and being mobilized or appointed to hold leadership or management positions or titles in state administrative agencies, they must meet the standards and conditions prescribed in this Decree but do not have to immediately meet the standards on state management as prescribed for the positions or titles expected to be appointed.
In these cases, the standards must be completed within 12 months from the date of appointment decision.
This Decree takes effect from May 1, 2024.
