Proposal not to organize People's Councils of districts and wards nationwide

In urban districts, wards and communes (including towns, provincial cities and centrally run cities), there is no People's Council (HĐND) but only a People's Committee (UBND).


Continuing the 42nd session, on the morning of February 5, the National Assembly Standing Committee gave opinions on the draft Law on Organization of Local Government (amended).

Presenting the Government's proposal, Minister of Home Affairs Pham Thi Thanh Tra said that the draft law stipulates the model of local government organization in the direction of expanding the application of the urban government model in districts of Ho Chi Minh City, Da Nang, and Hai Phong to apply to all districts of centrally-run cities.

At the same time, expand the application of the urban government model at the ward level of Hanoi, Ho Chi Minh City, Da Nang, and Hai Phong to apply to all commune-level administrative units under districts, towns, provincial cities, and centrally-run cities. The organization of the urban government of Hanoi city is implemented in accordance with the provisions of the Law on the Capital.

Regarding urban administrative units, Ms. Pham Thi Thanh Tra stated that in centrally-run cities, towns, provincial cities, cities under centrally-run cities, and towns, a full local government level will be organized, including the People's Council and the People's Committee.

"In urban districts, wards and communes (including towns, provincial cities and centrally run cities), there is no People's Council but only a People's Committee as the local administrative agency," said Minister of Home Affairs Pham Thi Thanh Tra.

For rural administrative units, the Government proposes that at the provincial, district and commune levels (except for urban communes), a full local government level including the People's Council and the People's Committee be organized.

Regarding administrative units on islands, the Minister of Home Affairs said that they will be organized in accordance with population size, natural area, geographical conditions, residents, socio-economic development requirements, and national defense and security assurance as decided by the National Assembly Standing Committee.

As for special administrative-economic units, the organization of local government will be prescribed by the National Assembly when establishing that special administrative-economic unit.

Regarding the organizational structure and operation of the People's Council, the Minister of Home Affairs said that the principles for determining the number of People's Council delegates will be stipulated based on population size, regional characteristics and socio-economic conditions of each locality.

The Law on Organization of Local Government (amended) will assign the National Assembly Standing Committee to regulate the number of People's Council deputies, the framework for the number of full-time People's Council deputies, and the framework for the number of Committees of People's Councils at all levels.

At the same time, the authority is delegated to the People's Council to decide on the establishment of Committees and the number of full-time delegates of the People's Council to ensure compliance with local realities.

Regarding the People's Committee, the draft law provides general regulations on the organizational structure of the People's Committee and assigns the Government to prescribe the framework for the number of specialized agencies under the People's Committees at the provincial and district levels, the number of Vice Chairmen, the number and structure of the People's Committees.

According to the Minister, the draft law stipulates the operating mechanism of the People's Committee where local government is organized (with People's Council) and where local government is not organized (without People's Council).

Examining this content, Chairman of the National Assembly's Law Committee Hoang Thanh Tung said that the Standing Committee of the Law Committee basically agrees with the Government's proposal on adjusting the organization of the local government model and local government levels in each type of administrative unit to suit urban, rural, mountainous and island areas.

Regarding the expansion of the scope of not organizing People's Councils in communes of towns, provincial cities, and centrally-run cities, the majority of opinions in the Standing Committee of the Law Committee believe that the provisions in the draft law are appropriate.

According to Mr. Hoang Thanh Tung, there are opinions suggesting that this expansion needs to be explained more thoroughly and convincingly because this is an issue that has a great impact and influence on the implementation of democratic institutions at the local level.

Besides, there are opinions that the local government organization model as proposed in the draft law is not consistent with the government organization model in Hanoi according to the provisions of the Capital Law.

"Therefore, we request the Government to clearly express its viewpoint on whether the organization of urban government in Hanoi in the coming time should continue to be implemented according to the Law on the Capital or will be implemented uniformly like other cities according to the provisions of the Law on Organization of Local Government," said the Chairman of the Law Committee.
