Strengthen inspection and handling of overloaded and oversized cargo transportation

To detect, prevent and strictly handle drivers and vehicle owners who carry overloaded or oversized cargo, or change the size of the vehicle's walls and cargo bed, the Traffic Police have stepped up patrols, controls and handling of violations.

Authorities mobilize forces, vehicles, and technical equipment to regularly patrol national highways, provincial roads, routes where overloaded vehicles often operate, and freight routes from wharves and yards...

Officers and soldiers focus on controlling drivers and vehicles of trucks, trailers or semi-trailers that show signs of violating the load limit or size limit of the vehicle or road without a circulation permit issued by a competent authority; arbitrarily renovating or changing the size of the vehicle's body or cargo.

Not only punishing the person directly driving the vehicle, the force also punishes the vehicle owner who violates the act of "Handing over the vehicle or allowing employees or representatives to drive the vehicle to commit violations..." as prescribed in Article 30 of Decree No. 100/2019/ND-CP of the Government regulating administrative sanctions in the field of road and railway traffic and a number of provisions amended and supplemented in Decree 123/2021/ND-CP.

In the first 6 months of 2023, the Traffic Police force of the whole province focused on handling the topic of transporting overloaded, oversized goods, and vehicles with extended cargo beds, with 360 cases. The authorities will continue to strengthen inspections and strictly handle violations, not allowing the situation of vehicles carrying overloaded, oversized goods, and vehicles with extended cargo beds to recur in the area.

Traffic inspectors in the province inspect and handle violations of road traffic safety order. In particular, the inspection and handling of overloaded vehicles transporting goods using portable scales and at mobile vehicle load inspection stations are strengthened, and violations are strictly handled.

According to the report of the Department of Transport, in the first half of 2023, the authorities organized mobile vehicle load inspections of more than 4,070 vehicles, thereby detecting violations of 14 vehicles, and issuing 28 administrative violation records (including 14 records of drivers and 14 records of vehicle owners). 11 vehicles had to unload, the unloaded weight was 88.4 tons; 5 driver's licenses were revoked. The situation of overloaded vehicles has significantly decreased, contributing to the protection of traffic infrastructure.

Mr. Pham Minh Tien, born in 1982, transported firewood from Tay Ninh to Binh Duong, traveling on route 781. The route often passed the weighing station, Mr. Tien presented all the necessary traffic permits and carried the correct load of the vehicle, which was 15 tons. The authorities at the weighing station worked quickly, supporting the driver to be able to travel early, ensuring strict compliance with regulations.

Mr. Nguyen Van Trieu, a driver of a wood truck traveling on Route 781, said: "When I met the authorities, I presented all the necessary documents and checked the vehicle's load capacity before being allowed to continue traveling."

Besides cases where drivers strictly comply with regulations, some people transporting oversized and overloaded goods secretly drive outside of patrol hours, informing each other to avoid checkpoints and controls of authorities.

To strengthen inspection and strictly handle cases of overloaded and oversized vehicles participating in traffic, causing public outrage, disrupting traffic safety and damaging road infrastructure, implementing the direction of the Ministry of Transport, the Inspectorate of the Ministry of Transport has sent a document to the Inspectorate of the Departments of Transport on organizing a peak period of inspection and handling of violations of vehicle load and loading of goods on cars at cargo loading and unloading hubs.

To effectively implement the above directive, from July 1 to 31, 2023, the Traffic Inspectorate (Department of Transport) will launch a peak period of inspection and handling of violations of road vehicle load and loading of goods on cars at cargo loading and unloading hubs in the province. During the course of their duties, the Traffic Inspectorate will focus on inspecting and handling violations of vehicle load and loading of goods on cars.

Units shall increase the use of professional technical equipment and means as prescribed in Decree No. 135/2021/ND-CP and Circular No. 51/2022/TT-BGTVT to collect evidence, determine violations and impose administrative penalties for expanding cargo containers.

At the points of loading and unloading goods on cars, the authorities focus on checking the conditions of the vehicles loading and unloading goods; the conditions of the vehicle drivers; and the vehicle load. For mobile inspections, the Traffic Inspectorate checks the vehicle load, the conditions of the drivers, and traffic safety rules...

Every day, Mr. Pham Van Manh, a truck driver, travels to the sandbank twice to transport sand in Duong Minh Chau district. Mr. Manh said: “Before leaving the sandbank, we move the truck to the weighing station to weigh the full load before leaving the yard. The truck I drive has a load capacity of 31 tons, if the weight is too much, I have to back up to unload until it meets the regulations. Carrying the correct load ensures the technical safety of the truck.”

According to the report of the National Traffic Safety Committee, in the second quarter of 2023, under the comprehensive direction of the Ministry of Public Security, the police force, especially the traffic police at all levels, has had many drastic, regular and continuous solutions in controlling vehicle load, so the situation of overloaded vehicles and violations of cargo size continued to decrease significantly. The traffic police handled 35,293 cases of overloading (accounting for 2.13%), 2,448 cases of violating regulations on building, converting and repairing vehicles (accounting for 0.15%).

To strengthen the control of vehicle load, the Ministry of Transport directs functional units to continue to synchronously and drastically implement tasks and solutions on vehicle load control according to the direction of the Prime Minister in Directive No. 32/CT-TTg and Directive No. 03/CT-BGTVT of the Minister of Transport on strengthening vehicle load control.

Handling oversized and overloaded vehicles - if only the police and traffic inspectors can solve the problem, it is necessary to have the role of local authorities in managing transportation businesses, material yards, and construction works.
