Former director received a bribe of 14.4 billion VND from AIC right in his office

The Supreme People's Procuracy has just issued an indictment to prosecute 14 defendants in the case of violating bidding regulations causing serious consequences, giving and receiving bribes that occurred at the International Progress Joint Stock Company (abbreviated as AIC Company), the Department of Planning and Investment of Ho Chi Minh City and the Center for Biotechnology of Ho Chi Minh City.

Among them, former Chairwoman of AIC Company Nguyen Thi Thanh Nhan was prosecuted for two crimes: bribery and violating bidding regulations causing serious consequences. Mr. Duong Hoa Xo, former Director of Ho Chi Minh City Biotechnology Center, was prosecuted for bribery.

Contract acquisition, causing damage of more than 94 billion

According to the indictment, in 2014, the Ho Chi Minh City Biotechnology Center was approved for a plan to select a contractor to supply equipment for the project, with phase 1 worth 149 billion VND, phase 2 worth about 200 billion VND, and phase 3 worth more than 75 billion VND.

Knowing that the center was implementing a project of 12 laboratories, Ms. Nguyen Thi Thanh Nhan approached Mr. Duong Hoa Xo and asked him to let AIC Company participate. Accordingly, the company wanted to be facilitated to win the bid, and at the same time set a price so that AIC could benefit from 40% of the bid package value.

After receiving Mr. Xo's consent, in 2015, when the first phase of the project, consisting of 4 packages, was implemented, the then General Director of AIC Company, Tran Manh Ha, met and negotiated with Mr. Xo, according to the content previously agreed upon with Ms. Nhan.

To carry out the "favorable" plan for AIC, Mr. Xo hired a valuation company and requested a certificate of valuation for the equipment to be purchased at 169 billion VND, while the initial estimate was only 149 billion VND.

Notably, to facilitate the acquisition of bid packages, Ms. Nhan also became acquainted with the defendant Tran Thi Binh Minh (former Deputy Director of the Department of Planning and Investment of Ho Chi Minh City). Since March 2016, because she was assigned to be in charge of the project of 12 laboratories at the Ho Chi Minh City Biotechnology Center, Ms. Minh met Mr. Xo many times.

At the end of November 2017, Mr. Xo signed a submission to the Department of Planning and Investment of Ho Chi Minh City, proposing to adjust the list of equipment and implementation time of phase 2 and phase 3 of the project. Because of this, the value of the entire project's equipment increased from 425 billion VND to nearly 469 billion VND.

Receiving the report, Ms. Minh directed her subordinates to implement it and at the same time, signed a decision approving the adjustment of the project and equipment price, increasing by nearly 44 billion VND as proposed.

On its side, AIC Company and the companies it designated to stand in its name won 8 bids. As a result, the total damage caused by the defendants was more than 94 billion VND.

6 times former director received money from AIC

Notably, the indictment determined that after AIC Company won the bids, Mr. Duong Hoa Xo received money 6 times, a total of 14.4 billion VND from Ms. Nguyen Thi Thanh Nhan (through subordinates at the company) right in Mr. Xo's office at the Ho Chi Minh City Biotechnology Center.

Specifically, around November 2016, Mr. Xo received 2.5 billion VND. Around January 2017, Mr. Xo received 3.9 billion VND. 3 months later, Mr. Xo received 2 billion VND. Around February 2019, Mr. Xo received 2 billion VND.

Around July 2019, Mr. Xo received another 2 billion VND. The last time was around September 2019, Mr. Xo received 2 billion VND.

In each time they gave money, Ms. Nguyen Thi Thanh Nhan's subordinates said that the money was from AIC Company as a thank you and hoped that Mr. Xo would create conditions for the company to continue implementing the bidding packages.

After receiving the money, Mr. Xo gave Ms. Tran Thi Binh Minh 1 billion VND; gave Mr. Nguyen Dang Quan, Deputy Director of the Ho Chi Minh City Biotechnology Center 950 million VND (given in many installments from 2016 - 2020); gave Mr. Nguyen Viet Thach (Head of Construction Investment Management Board of the Ho Chi Minh City Biotechnology Center) 1.1 billion VND.

The remaining 11.35 billion VND, Mr. Xo used for personal purposes.

In the above case, Ms. Nguyen Thi Thanh Nhan and 3 other defendants are on the run. The Supreme People's Procuracy calls on this group to surrender soon, enjoy the State's leniency policy and exercise their right to defense.

If the defendants continue to flee, the Supreme People's Procuracy will consider it an act of abandoning their right to defense, and they will be prosecuted and tried according to the provisions of the law.
