Emphasizing the Government's message of resolutely handling and resolving difficulties and obstacles for renewable energy projects, while strictly prohibiting lobbying, negativity and corruption, the Prime Minister requested efforts to complete before January 31, 2025, quickly deploy and maximize the efficiency of investment projects, contributing to promoting socio-economic development.
On the afternoon of December 12, at the Government headquarters, Prime Minister Pham Minh Chinh chaired an online conference to announce and implement the Government's Resolution on policies and directions to remove obstacles and difficulties for renewable energy projects.
Also attending the conference at the bridge locations were Politburo member, Permanent Deputy Prime Minister Nguyen Hoa Binh; Party Central Committee members: Deputy Prime Minister Tran Hong Ha, Minister of Industry and Trade Nguyen Hong Dien; leaders of ministries, branches, some localities, Vietnam Electricity Group and enterprises investing in 154 renewable energy projects.
According to reports and opinions at the Conference, by the end of 2023, the total capacity of renewable energy sources (wind power, solar power) in the power system will be 21,664 MW, accounting for about 27%; the cumulative annual electricity output of power sources (wind, ground-mounted solar, rooftop solar) will be about 27,317 million kWh, accounting for nearly 13% of the power system. These results contribute to implementing the orientation in the Power Plan VIII, Vietnam's commitment at the COP26 Conference to achieve "0" net emissions by 2050 and ensure energy security.
However, the implementation of the renewable energy development policy is a new solution, without precedent, lacking experience, and the legal system is not yet complete, so the implementation process still has some violations that have been specifically concluded by the Government Inspectorate.
Under the strong direction of the Government leaders, the Ministry of Industry and Trade and other ministries and branches have actively developed plans to remove difficulties and obstacles (sent to 8 ministries, agencies, 27 provinces and centrally-run cities for opinions; asked for opinions from members of the Steering Committee to remove difficulties and obstacles for projects; organized 03 meetings and 01 conference in Khanh Hoa; asked for opinions from members of the Government Party Committee. Thereby, ministries, agencies and localities all reached a high consensus on policies, viewpoints, goals and solutions to remove difficulties and obstacles for the above-mentioned renewable energy projects.
At the regular Government meeting in November on December 7, 2024, the Government gave its opinion on the Resolution on policies and directions to remove obstacles and difficulties for renewable energy projects. Based on the consensus of ministries, agencies and localities, the Ministry of Industry and Trade reported and the Government discussed and approved with a 100% rate, demonstrating a very high level of agreement with the policies, viewpoints, goals and solutions to remove difficulties and obstacles for renewable energy projects.
Delegates attending the Conference highly appreciated the Government's determination to make efforts and resolve difficulties and obstacles for renewable energy projects.
Resolved before January 31, 2025
In his concluding remarks, Prime Minister Pham Minh Chinh emphasized that the Conference was organized in the spirit of considering, listening, sharing, and understanding on the basis of harmonious interests between the State, businesses, and people, harmonious benefits, and shared risks.
The Government has put forward some general viewpoints and principles to resolve difficulties for projects in general, especially with honest parties, thereby not wasting social resources, not reducing the confidence of domestic and foreign investors. As for specific projects, the locality will be assigned to proactively work with enterprises to resolve them within their authority, and if beyond their authority, they will be reported to competent authorities. Violations need to be separated, and specific responsibilities for related individuals need to be handled, without legalizing violations, but with solutions, mechanisms and policies to resolve them.
Emphasizing some more contents, the Prime Minister stated that the immediate removal of obstacles to deploy and put into operation renewable energy projects is an objective and urgent requirement. If renewable energy projects are not removed to put into operation, they will cause waste of invested capital; waste of electricity, and cannot supplement electricity sources while we are in dire need, especially in the period of 2026-2030. Removing difficulties and obstacles for these projects will be an important basis for increasing electricity sources to serve the socio-economic development goals in 2025 and the coming time. The solutions to remove obstacles are highly agreed upon by ministries, branches and local agencies, and have been approved by the Government, so they need to be thoroughly implemented immediately, urgently, synchronously and effectively.
"The Government's message is to resolutely handle and resolve difficulties and obstacles, quickly deploy and maximize the efficiency of investment projects, contributing to promoting socio-economic development, in which GDP growth in 2025 will reach at least 8%," the Prime Minister said.
In terms of viewpoint , the Government determines to resolve difficulties with the spirit of choosing the optimal solution based on analysis, evaluation, comparison of socio-economic benefits and minimizing disputes, complaints, and impacts on the investment environment; ensuring security and order, national energy security and harmonizing the interests of the State, investors, enterprises and people.
Criminal proceedings are the last resort to facilitate the removal of obstacles for projects through economic solutions; if the current law changes, does not cause consequences, and there is no corruption, then no criminal proceedings are required.
Removing difficulties and obstacles for projects is considered legal when approved by competent authorities. Protecting the rights and legitimate interests of bona fide third parties according to the law.
Do not create new violations, do not let negative corruption and bad consequences arise in the handling process, especially mistakes being piled on top of mistakes.
Regarding the solution, agree to handle and allow additional planning for implementation in case the project does not violate regulations related to national security and defense, planning of key national works and projects.
For projects with violations of procedures and processes related to land and construction works, they are allowed to be completed according to the provisions of law.
For projects that violate planning on minerals, irrigation, national defense, etc., an assessment of the socio-economic efficiency between planning implementation and project implementation must be conducted to adjust overlapping planning accordingly or integrate and simultaneously implement both renewable energy projects and related planning.
For projects that are enjoying FIT prices but violate the Conclusion of competent authorities due to the fault of the enterprise and do not fully meet the conditions for enjoying FIT prices, they will not be entitled to preferential FIT prices but must re-determine the electricity purchase and sale prices according to regulations; recover the preferential FIT prices that have been enjoyed incorrectly through offset payment for electricity purchases.
The Prime Minister stated that the authority of each level must resolve the issue publicly and transparently according to the solutions proposed by the Government; trying to resolve it completely before January 31, 2025.
Regarding the implementation of the Resolution, the Prime Minister requested ministries, branches and localities to thoroughly grasp the sense of responsibility, remove difficulties, and immediately handle obstacles within their authority for projects on the principle that obstacles at which level must be handled and resolved, and not pushed to higher levels or handled in a roundabout way.
For projects that have been prosecuted, violations will only be handled and remedied after a verdict has come into effect according to the provisions of law. Handling of problems must be public and transparent; handling of problems for the purpose of corruption and group interests is strictly prohibited.
"The removal of difficulties and obstacles with renewable energy projects must be public and transparent, without causing difficulties, inconveniences, or harassment. The Government has issued a policy to remove them, and localities must work with businesses to remove difficulties and obstacles. No one must resort to lobbying. In particular, lobbying, negativity, and corruption must be strictly prohibited, leading to loss of people, loss of property, loss of time, loss of trust, and loss of opportunities. If anyone resorts to lobbying, the authorities will handle it strictly," the Prime Minister emphasized.
The Prime Minister also assigned specific tasks to agencies, localities, and Vietnam Electricity Group.
In particular, local Party committees and authorities lead and direct their subordinate agencies to strictly implement the Government's Resolution, and direct competent agencies to regularly monitor and inspect the implementation. At the same time, they focus on reviewing and promptly handling difficulties of projects within their authority, overcoming violations pointed out by the Inspectorate; proactively reviewing difficulties and obstacles, coordinating with relevant agencies and enterprises with projects in the area to effectively implement the Government's Resolution...
The Ministry of Industry and Trade shall preside over a thorough review of difficulties and obstacles of renewable energy power projects, propose competent authorities to handle each obstacle; promptly review, study and propose adjustments to the Power Plan VIII and the Power Plan VIII Implementation Plan to update and supplement appropriate projects into the planning; review mineral exploitation plans to handle obstacles, propose adjustments and supplements if necessary; inspect and urge ministries, agencies and localities to implement the Government's Resolution to promptly remove obstacles for projects and enterprises; promptly report to the Prime Minister on implementation results and obstacles and arising cases beyond their authority, if any; direct the National Power System Operation Company and related units to support and facilitate procedures for renewable energy projects to connect to the national grid.
For investors, actively and proactively remedy all violations and shortcomings pointed out by competent authorities; be responsible for strictly and fully implementing the investment, construction and operation procedures of the project in accordance with the provisions of law, coordinate with relevant agencies to resolve difficulties, and implement remedies in accordance with the Government's Resolution.
Vietnam Electricity Group focuses on reviewing and overcoming the shortcomings and violations mentioned in the Conclusion of the Government Inspectorate or the decision of the competent authority; coordinates with ministries and branches to classify the violation groups and agree on the handling content; in cases beyond EVN's authority, it reports to the competent authority for consideration and resolution; directs the Electricity Trading Company to create favorable conditions for renewable energy projects to promptly complete the procedures for purchasing and selling electricity with the Group.
