Accordingly, the People's Committee of Ha Dong District organized the third round of enforcement against 33 households in residential groups 6, 7, 14, 15, Quang Trung Ward to serve the Yen Nghia Pumping Station Project. This is a key project of Hanoi City, approved for investment in Decision No. 1834/QD-UBND dated February 23, 2013, adjusted and extended many times due to incomplete site clearance work.
Vice Chairman of Ha Dong District People's Committee Bui Xuan Ha said: "During the process of implementing the land acquisition and clearance work, Ha Dong District People's Committee has directed departments, units, and People's Committees of wards to fully and correctly implement the prescribed procedures; carefully review land management records archived in different periods, collect documents provided by people whose land is recovered, organize conferences to collect opinions, verify and clarify related contents to serve as a basis for developing compensation, support and resettlement plans (BTHT-TDC) according to regulations.
When problems arose (especially in determining the origin of land, conditions for compensation and support), the District People's Committee promptly compiled reports to the City People's Committee and relevant departments, organized working conferences with the City's departments to propose and ask for guidance on solutions. Pursuant to legal regulations, on the basis of the City People's Committee's directives, instructions from relevant departments, and documents related to each household, the District People's Committee issued decisions on land recovery and decisions approving the compensation and resettlement plan in accordance with regulations.
It is known that recently, the District People's Committee, specialized departments of Ha Dong District, Party Committee, People's Committee, Fatherland Front Committee of wards have organized meetings, meetings, answered questions of people, explained the BTHT-TDC policy regime, and propagated and mobilized households to comply with the land recovery decision. Up to now, basically households have voluntarily complied and handed over land to the State to implement the project; only 185 households, with an area of 0.61 ha in the wards of Quang Trung, Ha Cau, Yet Kieu, Duong Noi, La Khe still do not comply, must establish records, and enforce land recovery according to regulations.
Regarding the petitions of the households, the People's Committee of Ha Dong district has compiled a report and proposed the City People's Committee to consider. Households that are not eligible for compensation for land but have used it before July 1, 2004, have to move, and are eligible to buy apartments, have been allocated housing funds in Cau Giay district by the City People's Committee for resettlement; for households that are not eligible to buy apartments, the City People's Committee has allowed Ha Dong district to support rent for households for 6 months (1 million/month for each person, no more than 4 people per household).
The People's Committees of the wards have found and introduced rental locations to ensure housing for each household when the State reclaims the land. Particularly for Quang Trung ward, up to now, there are 135 households that have not handed over the premises, of which the third phase of enforcement applies to 33 households in residential groups 6, 7, 14, 15.
Regarding the implementation of land acquisition and site clearance in Quang Trung and Ha Cau wards: The area of land acquired in Quang Trung and Ha Cau wards is 76,869m2 (of which 2,601.4m2 of land belongs to Ha Cau ward) related to 268 households, individuals and 7 organizations acquired for the project (of the 268 households, 48 households have a part of the land area in Ha Cau ward).
Regarding land origin, there are 20 households in the Pharmaceutical Military Zone 3 collective housing area (14 households have documents proving that the Pharmaceutical Military Zone 3 Enterprise allocated land; 6 households do not have documents proving it); 2 households in the Agricultural and Foodstuff collective housing area, 3 households in the Education Department collective housing area, 3 households in the Auto Repair Center collective housing area (all do not have documents proving it), 5 households arbitrarily used land in the canal corridor to build houses.
Although most households used the land before October 15, 1993, some households used it before July 1, 2004, based on the guidance of the Department of Natural Resources and Environment, the City's Inter-agency, and on the basis of confirmation from the Nhue River Irrigation Company, all of the above cases were confirmed by the Ward People's Committee that the land origin was occupied canal corridor land, therefore, no compensation for land, no resettlement by land.
All 33 households have been paid by the organization. The Ward People's Committee, the Ward Fatherland Front, the unit in charge of land acquisition and clearance and related units have propagated and mobilized, but they deliberately did not receive money, did not comply with the decision to recover land, and hand over the site to implement the Project (a record has been established and kept on file).
On September 18, the Ha Dong District Land Acquisition Enforcement Board continued to organize propaganda and mobilization before the enforcement. By 12 o'clock on the same day, 27/33 households in residential groups 6, 7, 14, 15 (Quang Trung Ward) had voluntarily handed over their land; 4 households were subject to enforcement, 1 household was temporarily postponed according to the direction of the Chairman of the Ha Dong District People's Committee.
