The above content is mentioned in Resolution 126 of the Government on the August law-making thematic meeting, including content related to the draft Law amending and supplementing a number of articles of the Law on Officers of the Vietnam People's Army.
Accordingly, the Government agreed on the necessity of promulgating the Law to institutionalize the Party's guidelines and policies and the State's policies on building the Vietnam People's Army, including building the officer corps. At the same time, amend and supplement regulations to overcome difficulties and inadequacies, ensuring compliance with reality.
Notably, regarding the maximum age limit for officers to serve in the army, the Government requested the Ministry of National Defense to study and absorb the maximum opinions of Government members in the direction of unifying regulations on equal retirement ages for male and female officers.
Regarding the authority to specifically stipulate the position with the highest military rank of Lieutenant General, Major General and the highest military rank for the position and title of an officer is the general rank of a newly established unit or a reorganized unit, the Government requests the Ministry of National Defense to clearly report and request the National Assembly to decentralize the authority to the Government.
The Government assigned the Ministry of National Defense to coordinate with the Ministry of Labor, War Invalids and Social Affairs to complete the content on retirement conditions, ensuring consistency with the provisions of the Labor Code and the Law on Social Insurance, and at the same time being suitable to the characteristics of military officers.
The Government also agreed on the direction of social housing development for the Army; especially for forces in remote, border and island areas, in accordance with the characteristics of the Army and the capacity of the locality; ensuring consistency and synchronization with the provisions of the Housing Law, Land Law, Planning Law, etc.
At the request of the Government, the Minister of National Defense, authorized by the Prime Minister, on behalf of the Government, signed and submitted to the National Assembly for consideration and approval of the draft Law amending and supplementing a number of articles of the Law on Officers of the Vietnam People's Army at the 8th Session of the 15th National Assembly.
According to the current Law on Officers of the Vietnam People's Army, the maximum age limit for military officers is divided according to rank. Specifically, the age limit for lieutenant is 46 years old; the age limit for major is 48 years old; the age limit for lieutenant colonel is 51 years old; and the age limit for senior colonel is 54 years old. The above ages apply to both men and women.
From the rank of colonel, the highest age limit for men is 57 years old, and for women is 54 years old. For the rank of general, men is 60 years old, women is 55 years old.
