Directive of the Secretariat on continuing to strengthen the Party's leadership over occupational safety and hygiene work

After 10 years of implementing Directive No. 29-CT/TW, dated September 18, 2013 of the Secretariat on promoting occupational safety and hygiene in the period of industrialization, modernization and international integration, many positive results have been achieved, the rate of serious occupational accidents has decreased. Awareness and responsibility of Party committees, Party organizations, authorities, agencies, organizations, enterprises, workers and society have been raised. Policies and laws on occupational safety and hygiene continue to be improved, expanding the scope of application to areas without labor relations.

Prevention, risk assessment, control of dangerous and harmful factors; health care for workers, improvement of working conditions and risk support mechanisms for businesses and workers are given more attention. Strengthening state management responsibilities, assigning tasks, decentralizing, and coordinating more closely between agencies, organizations and localities. Expanding international cooperation and integration; promoting socialization, developing training services, technical inspection of labor safety, and monitoring of the working environment.

However, occupational safety and hygiene work has not met requirements, the number of occupational accidents has not decreased, occupational diseases have not been given attention, especially in areas without labor relations. Some Party committees, authorities, enterprises, production and business establishments, and workers have not attached importance to occupational safety and hygiene work; investment resources and state management work are still limited; due attention has not been paid to prevention, inspection, examination, supervision, detection, and handling of violations. The awareness of law compliance of workers and employers is not strict. Research and application of advanced science and technology on occupational safety and hygiene have not kept up with reality.

To promote occupational safety and hygiene to meet the requirements of the new situation in line with the Resolution of the 13th National Party Congress, the Socio-Economic Development Strategy, the goals of industrialization, modernization of the country and international integration, the Secretariat requests Party committees at all levels, Party organizations, authorities, the Vietnam Fatherland Front and socio-political organizations to focus on leading and directing the good implementation of the following key tasks and solutions:

1. Ensure the rights of workers to work in safe and hygienic working conditions and protect the assets, rights, and legitimate interests of the State, enterprises, organizations, and individuals. Raise awareness and responsibility of Party committees, Party organizations, authorities, agencies, organizations, enterprises, and workers.

Strengthen leadership, direction, guidance, inspection and supervision of the implementation of the Party's guidelines and the State's policies and laws; closely combine proactive prevention with detection and strict handling of violations. Promote the responsibility of leaders for occupational safety and hygiene, considering this a regular, long-term task of great significance in socio-economic development, ensuring human security, contributing to the sustainable development of enterprises and the country.

Strive to reduce occupational accidents, especially serious occupational accidents, the rate of fatal occupational accidents decreases by at least 4%/year; the number of workers working in environments exposed to risk factors who are examined and detected for occupational diseases increases by at least 5%/year; the number of establishments generating harmful factors whose working environment is monitored increases by at least 5%/year.

2. Regularly disseminate, popularize and educate the law on occupational safety and hygiene to leaders, managers, enterprises, production and business establishments, employers and employees. Create conditions for employees, especially those working in areas without labor relations, to access information on issues related to occupational safety and hygiene, raise awareness, responsibility and proactive prevention.

Innovate content, diversify forms of information and propaganda to suit each group of workers, pay attention to high-risk industries and fields. Improve efficiency, attract participation of businesses and workers in the Month of Action on occupational safety and hygiene, and Workers' Month every year.

Promote the role of the Vietnam Fatherland Front, socio-political organizations, mass organizations, and press agencies in mobilizing, propagating, and building a culture of labor safety among union members and the people. Promote dialogue and negotiation activities on ensuring labor safety, hygiene, and working conditions, contributing to building harmonious, stable, and progressive labor relations.

3. Review, supplement and improve policies and laws, promptly overcome limitations and shortcomings in practice, focusing on policies to prevent, minimize and overcome risks of occupational accidents and diseases; rights and obligations of employees, employers, trade unions and related organizations; labor protection and health care regimes for employees; measures to prevent, respond to and handle occupational accidents; technical standards and regulations on occupational safety and hygiene... to ensure consistency, synchronization, feasibility, and conformity with international treaties that Vietnam participates in, and access to world standards.

4. Improve the effectiveness and efficiency of state management, decentralization, delegation of authority, regular inspection and supervision, ensure that policies and laws are strictly implemented; effectively implement the National Program on occupational safety and hygiene. Promote administrative reform, especially administrative procedures in a practical, simple, public, transparent manner, saving time and costs for businesses and employees.

Build a specialized database to improve the effectiveness of state management, promote the application of information technology, digital transformation in the management, reception and reporting of occupational accidents and diseases. Proactively and actively integrate internationally in occupational safety and hygiene; enhance the exchange of information, experience, training cooperation, and experts with other countries.

Focus on environmental impact assessment, especially for investment projects in mining, industrial production, construction and installation, where there are arduous, toxic and dangerous working conditions; control hazardous and harmful factors in the workplace; regularly review and supplement the list of arduous, toxic and dangerous occupations and jobs, and occupational diseases. Strictly implement the declaration, statistics, reporting and investigation of incidents causing unsafety, occupational hygiene, work accidents and occupational diseases.

Pay attention to occupational safety and hygiene for female workers, minors, people with disabilities, the elderly, domestic workers, apprentices, trainees, probationary workers, and subcontracted workers, and Vietnamese workers working abroad. Implement well the policies on periodic health check-ups, assessments, health care, rehabilitation, treatment, wages, medical expenses, subsidies, compensation, insurance, and other policies as prescribed for people with work-related accidents and occupational diseases.

Strictly manage occupational safety and hygiene training services; monitor the working environment; conduct periodic health check-ups, examine and detect occupational diseases; inspect machinery, equipment, and materials with strict requirements on occupational safety. Improve the quality of medical facilities for examination and treatment of occupational diseases; nursing and occupational rehabilitation facilities; occupational safety and hygiene departments, medical departments, and occupational safety and hygiene councils at production and business establishments to meet requirements.

5. Improve the organizational structure, improve the quality of human resources, focus on training, coaching, transferring and updating knowledge and skills on occupational safety and hygiene, prevention and control of occupational diseases, especially for those working in occupational safety and hygiene, health at enterprises, production and business establishments; labor inspectors, occupational safety and hygiene inspectors, including areas without labor relations. Promote research and application of advanced science and technology in taking care of workers' health, ensuring occupational safety and hygiene.

6. Increase State and enterprise resources for investment in occupational safety and hygiene in conjunction with innovation in financial mechanisms, improving the efficiency of resource use, prioritizing resource allocation to implement measures to prevent occupational accidents and diseases for areas without labor relations. Party committees, party organizations, and authorities at all levels should pay attention to integrating occupational safety and hygiene into socio-economic development programs and plans of sectors and localities; programs and projects related to the fields of labor, health, and environment.

Promote socialization, mobilize and effectively use domestic and foreign resources for occupational safety and hygiene. Encourage enterprises to proactively invest, implement preventive measures, strengthen self-inspection, and minimize occupational accidents and diseases. Strictly manage and effectively use the Occupational Accident and Disease Insurance Fund in the direction of flexible contributions and benefits, increase the benefits and appropriate support levels for beneficiaries to ensure stable lives, expand and rapidly develop the subjects participating in voluntary occupational accident insurance with support from the State.

7. Improve the effectiveness of coordination between ministries, branches, localities, especially the labor, health, and environment sectors with localities, enterprises, production and business establishments according to assigned functions and tasks, focusing on areas without labor relations. Timely detect, replicate, commend, reward collectives, individuals, good models, effective practices and strictly handle violations, especially organizations and individuals that cause serious incidents related to labor safety and hygiene.

8. Implementation organization

- Provincial Party Committees, City Party Committees, Party Committees, Party Executive Committees, Party Delegations, and Party Committees directly under the Central Committee shall lead, direct, disseminate, concretize, and effectively organize the implementation of the Directive in accordance with the assigned functions and tasks and the realities of the agencies, localities, and units.

- The National Assembly Party Delegation and the Government Party Committee shall lead and direct the review, revision, supplementation and completion of relevant policies and laws; allocate resources; strengthen inspection and supervision of the implementation of the Directive.

- The Government Party Committee leads and directs the development of a Plan to implement the Directive; effectively organizes the implementation of the National Program on occupational safety and hygiene for the period 2021 - 2025 and the following years; strengthens the state management capacity of relevant ministries, branches and local authorities.

- The Party Committee of the Vietnam Fatherland Front, the Vietnam General Confederation of Labor, the Vietnam Farmers' Union and other socio-political organizations and mass organizations assigned by the Party and the State to strengthen the work of mobilizing, propagating, supervising and providing social criticism to contribute to the effective implementation of the Directive.

- The Central Economic Committee presides over and coordinates with the Party Committee of the Ministry of Labor, War Invalids and Social Affairs and relevant agencies to guide, urge, inspect, supervise, summarize, and report to the Secretariat on the implementation results of the Directive.
