The Ministry of Home Affairs is urgently developing and promulgating documents amending and supplementing a number of articles of Decree 178/2024/ND-CP so that localities have a basis to implement policies when restructuring the apparatus.
At the first conference of the Party Executive Committee of the Ministry of Home Affairs for the 2020-2025 term held on March 10, Minister of Home Affairs Pham Thi Thanh Tra emphasized that the core and continuous task of the units is to promote the building and completion of the institutional system.
According to Minister Pham Thi Thanh Tra, in 2025, the Ministry of Home Affairs has many tasks that require consulting and amending a number of laws and related documents such as: Law on Organization of Local Government; Law on Cadres and Civil Servants; Law on Public Employees... In particular, the Ministry needs to advise competent authorities to amend a number of articles stipulated in the Constitution to perfect the contents related to provincial-level administrative units and local governments.
The Minister of Home Affairs pointed out that the task of amending and supplementing a number of articles of Decree 178/2024/ND-CP also has high requirements, is really "hot", and is awaited by ministries, branches and localities.
“According to Conclusion No. 75-TB/TW of the Politburo, this is a very urgent task that cannot be delayed any longer and must be issued soon so that ministries, branches and localities have a basis for implementation. After amending the Decree, we must continue to amend the Circular to ensure synchronous implementation,” Minister Pham Thi Thanh Tra emphasized.
According to Conclusion No. 75-TB/TW of the Politburo on adjusting the scope and subjects of application of policies and regimes for cadres, civil servants, public employees, workers and armed forces in the implementation of the apparatus arrangement of the political system, after listening to the Government Party Committee's report on the adjustment and opinions of the agencies, the Politburo discussed and basically agreed on the policy of adjusting the scope and subjects of application of Decree 178/2024/ND-CP with 3 groups of subjects including:
The first group includes: Cadres who are not old enough to be re-elected or re-appointed and cadres who are old enough to be re-elected or re-appointed to the same-level Party Committee with a working period from the date of the congress starting from 30 to 60 months are old enough to retire and cadres who are participating in Party Committees in Party Committees that must end their activities and consolidate the organizational apparatus, and have a working period of 60 months or less are old enough to retire, and who wish to retire early to create conditions for personnel arrangement and are approved by competent authorities (stipulated in Clauses 1, 2, 3, 4, Article 2, Decree 177/2024/ND-CP).
The second group includes: Cadres, civil servants, public employees, and workers receiving salaries from the state budget according to the provisions of the labor law before January 15, 2019, who have 5 years left until retirement age in public agencies and units of the Party, the State, and socio-political organizations from the central to district levels and the armed forces, who are not directly affected by the reorganization of the apparatus but must streamline the payroll, streamline the apparatus, restructure and improve the quality of the contingent of cadres, civil servants, and public employees of the political system.
The third group is people working within the payroll quota and receiving salaries from the state budget at associations assigned by the Party and State at the central and local levels due to the direct impact of the implementation of organizational arrangement, consolidation and merger.
The Politburo assigned the Government Party Committee to absorb the Politburo's opinions and direct the Ministry of Home Affairs to urgently and thoroughly review the provisions of the decree to make reasonable adjustments to thoroughly resolve problems arising in practice and feasibility during implementation; ensure consistent implementation of policies, in line with goals, and create favorable conditions for the implementation of organizational arrangements of the political system.
Currently, Decree 178/2024/ND-CP dated December 31, 2024 of the Government on policies and regimes for cadres, civil servants, public employees, workers and armed forces in implementing the organizational arrangement of the political system stipulates the subjects of application including:
1. Cadres, civil servants, public employees, and people working under labor contracts in agencies, organizations, units, and armed forces under the organizational structure and administrative units at all levels prescribed in Article 1 of this Decree, including:
a) Cadres, civil servants, leaders, managers and civil servants;
b) Commune-level officials and civil servants;
c) People working under labor contracts according to the provisions of labor law before January 15, 2019 and people working under labor contracts are subject to policies like civil servants;
d) Officers, professional soldiers, workers and defense officials of the Vietnam People's Army;
d) Officers, non-commissioned officers receiving salaries, police workers and contract workers receiving salaries from the state budget belonging to the People's Public Security;
e) People working in key organizations.
2. Cadres who do not meet the age requirements for re-election or re-appointment to positions and titles according to their terms in agencies of the Communist Party of Vietnam, the State, socio-political organizations, and cadres who resign at will shall comply with the provisions of other Decrees of the Government.
