With many important and groundbreaking new points, the Law on Promulgation of Legal Documents takes effect from April 1, 2025.
On the morning of March 11, at the Presidential Palace, the Office of the President held a press conference to announce the President's Order promulgating the Law on Promulgation of Legal Documents, passed by the 15th National Assembly at the 9th Extraordinary Session.
Co-chairing the Press Conference were: Deputy Head of the Office of the President Pham Thanh Ha; Deputy Minister of Justice Nguyen Thanh Tinh; Vice Chairman of the Central Committee of the Vietnam Fatherland Front Hoang Cong Thuy.
Attending the Press Conference were: Member of the National Assembly, full-time member of the National Assembly's Committee on Law and Justice Tran Thi Kim Nhung; leaders of relevant Party Committees, Ministries and branches; representatives of leaders and reporters of news agencies.
At the press conference announcing the President's Order, Deputy Minister of Justice Nguyen Thanh Tinh said that the development of the Law on Promulgation of Legal Documents (amended) aims to promptly remove institutional bottlenecks, continue to perfect the legal framework for the development and operation of a unified, synchronous, transparent, feasible, accessible, effective and efficient legal document system, and easy to apply in practice; thereby unleashing all potentials and resources, creating new momentum for the country's rapid and sustainable development in the new era.
The development of the Law ensures the comprehensive and direct leadership of the Party in the work of building laws, specifically the timely and complete institutional guidance of the Politburo, the General Secretary, the Prime Minister, and the Chairman of the National Assembly on strongly innovating the thinking of building laws.
Accordingly, the provisions of the law must be stable and long-term, regulating issues under the authority of the National Assembly, while frequently fluctuating issues must be regulated by the Government, ministries, branches, and localities.
At the same time, ensure the constitutionality, legality, consistency, and uniformity of the legal system and compatibility with international treaties to which Vietnam is a member; selectively refer to the experiences of other countries in developing and promulgating legal documents; inherit the relevant contents of the 2015 Law; innovate the law-making process in the direction of ensuring professionalism, science, timeliness, feasibility, and efficiency, along with strengthening discipline, discipline, and responsibility of agencies, especially leaders in law-making.
Along with that, it is necessary to ensure and invest resources in the work of building and organizing the implementation of legal documents commensurate with the nature of strategic breakthroughs, "breakthroughs of breakthroughs"; ensuring the connection between the work of building and organizing the implementation of legal documents.
Regarding the new points of the Law, the Deputy Minister of Justice said that with a significant reduction in the number of chapters and articles compared to the 2015 Law on Promulgation of Legal Documents, Conclusion No. 119-KL/TW on "researching and amending the Law on Promulgation of Legal Documents in the direction of only specifically regulating the order and procedures for drafting and promulgating legal documents of the National Assembly and the National Assembly Standing Committee" has been institutionalized, ensuring a shortened time, but still improving "productivity", promptly meeting the requirements of the country's development practices in the new era, ensuring the quality of legal documents, and at the same time supplementing the content on the organization of implementation of legal documents.
Simplifying the system of legal documents, the Law has redefined the authority to issue legal documents of a number of entities according to the 2013 Constitution; removed the authority to issue legal documents of commune-level authorities; added 1 form of legal document issued by the Government, which is a resolution to resolve urgent and important issues arising from practice.
In addition, the Law has strongly innovated the establishment of the annual legislative program with high flexibility, the policy process is implemented independently from the establishment of the annual legislative program; supplemented the form of collecting opinions as policy consultation in the process of formulating policies for draft laws, resolutions of the National Assembly, ordinances of the National Assembly Standing Committee; stipulated that the submitting agency presides over the reception and revision of the draft law, and is responsible until the project is passed or signed for promulgation...
Supplementing regulations on the organization of the implementation of legal documents is a new point of the Law, aiming to overcome the cause that legal documents have not clearly defined which activities belong to the organization of law enforcement and prescribed the responsibilities and obligations for the subjects; therefore, leading to the implementation of the work of organizing law enforcement not being effective and substantive. The organization of the implementation of legal documents has stipulated the basic contents for competent agencies and individuals to organize the implementation of legal documents after they are issued; the responsibility for organizing the implementation of legal documents and reporting or providing information on the organization of implementation.
Regarding the supplementary provisions guiding the application of legal documents, the Law clearly states that competent agencies and individuals issuing legal documents shall review and provide guidance on the application of documents issued by themselves in administrative documents, based on the requests of agencies, organizations and individuals.
In addition, the 2025 Law also has new contents on the responsibilities of agency heads in the process of developing and organizing the implementation of legal documents; applying digital technology and digital transformation in document development; resources to ensure the development and implementation of legal documents...
The Law on Promulgation of Legal Documents consists of 9 chapters and 72 articles, effective from April 1, 2025.
