Nghe An Dermatology Hospital illegally collected 1.6 billion VND from 24,000 patients

No testing but still collect money

Nghe An Provincial Department of Health has just had verification results related to signs of violations at Nghe An Dermatology Hospital (address: Le Hong Phong Street, Hung Binh Ward, Vinh City, Nghe An Province) directed by Mr. Huynh Phuc Son.

Verification results related to signs of violations at Nghe An Dermatology Hospital.

Verification results show that, according to the report on the total data of fungal and scabies stains from January 1, 2019 to December 13, 2021, the hospital collected money from 24,699 people for testing with an amount of more than 1.6 billion VND.

Meanwhile, the testing department staff confirmed that during the above period, the hospital did not perform fungal staining and scabies staining testing services. “Not performing testing but collecting money is a violation of the law,” the Nghe An Department of Health document affirmed.

In addition, this hospital created fake labor contracts for 7 nurses showing that the contracts were signed on December 31, 2020 and had a term of 6 months (from January 1, 2021 to June 30, 2021). However, the verification process showed that these 7 nurses did not work at the hospital.

Regarding the reflection that the hospital reported higher statistics on medical examination and treatment revenue in the draft project to establish the hospital than the actual data; the conclusion clearly states that the reflection is true.

Accordingly, the actual revenue from medical examination and treatment (when Nghe An Dermatology Hospital was still the Center for Leprosy Prevention and Dermatology) in 2016 and 2017 was only over 1.7 billion VND, but in the project to establish the hospital, it was raised to over 8 billion VND and over 10 billion VND respectively. In 2018, in reality, only over 2.6 billion VND was inflated to 12.2 billion VND. The authorities approved the inflated figure.

This hospital also violated bidding regulations when it did not have a winning bid but the hospital allowed Hoang Anh Investment, Trade and Construction Joint Stock Company to dismantle and repair the roof of the Laser and Cosmetic examination building; repair the pharmacy warehouse and hospital parking lot in 2022. However, the two sides resolved the issue by having the contractor voluntarily donate the project to the hospital, causing no damage to the budget.

Responsibility belongs to the hospital director

The conclusion of Nghe An Department of Health also pointed out the violations of each individual and collective, in which Mr. Huynh Phuc Son alone committed the most violations as the head of Nghe An Dermatology Hospital.

This hospital created fake labor contracts for 7 nurses.

Regarding the incorrect data in the draft project to establish a hospital submitted to competent authorities for approval and the creation of false labor contracts for 7 nurses, "These two acts are related to the results of the approval of the project to establish a hospital and the conditions for granting a license for medical examination and treatment. The Department of Health requests the People's Committee of Nghe An province to allow Nghe An Dermatology Hospital to overcome the shortcomings and limitations, and continue to conduct medical examination and treatment activities according to the assigned functions and tasks."

Regarding the violation of not performing tests but collecting money, the amount of more than 1.6 billion VND, Nghe An Department of Health requested Nghe An Provincial People's Committee to assign competent authorities to inspect and clarify.

Regarding violations in the bidding process, the Department of Health proposed that the Provincial People's Committee assign the Department of Planning and Investment of Nghe An province to inspect, clarify this violation and handle it according to the provisions of law.

Regarding the handling measures for violations at Nghe An Dermatology Hospital, Nghe An Department of Health requested the Party Committee and hospital leaders to seriously review the groups and individuals that committed the violations, and at the same time consider appropriate disciplinary measures for the violating individuals and groups (if any). The Department of Health also requested to report the results of the review, take corrective actions and handle violations according to its authority to the Department of Health before June 30.

Previously, the Vinh City Tax Department conducted an inspection and discovered that from the beginning of 2021 until now, Nghe An Dermatology Hospital has not declared and paid taxes for obligations arising at the hospital pharmacy. In addition, from the beginning of 2022 to August 18, 2022, the hospital has not accounted for the pharmacy's revenue and expenditure, and has not paid debts to distributors in the amount of VND 5.2 billion.

Nghe An Dermatology Hospital even self-declared additional tax declarations for 2021 and 3 quarters of 2022, resulting in more than 200 million VND in tax payable. Of which, value added tax is more than 126 million VND; corporate income tax is more than 73 million VND; late payment of tax is nearly 15 million VND. After the Tax Department pointed out in writing, Nghe An Dermatology Hospital paid nearly 215 million VND to the State budget.

In addition, Nghe An Department of Health also pointed out the violations of this hospital such as submitting tax declaration documents more than 90 days past the deadline; issuing invoices at the wrong time according to the law on sales invoices, service provision... This agency has sent a report to the Provincial People's Committee to ask for instructions for further handling.

On September 6, 2019, the People's Committee of Nghe An province issued Decision No. 2512/QD-UBND approving the project to establish Nghe An Dermatology Hospital on the basis of upgrading the Center for Leprosy Prevention - Dermatology located at Le Hong Phong Street, Vinh City. On September 23, 20219, Nghe An Dermatology Hospital was officially established by the People's Committee of Nghe An province . This hospital currently has 5 departments, with a total of 34 employees. Immediately after its establishment, Nghe An Dermatology Hospital had to be autonomous in group II according to Decree No. 85/2012/ND-CP, and by the end of 2020, it would not receive regular budget support. Since then, this unit has had many serious violations related to finance.
