No staff, operating like… a business
According to Decree No. 56/2022/ND-CP dated August 24, 2022 of the Government stipulating the functions, tasks, powers and organizational structure of the Ministry of Transport, in addition to the Departments, Institutes, Schools, etc., the Ministry also has 8 specialized management Departments, corresponding to the fields: roads, railways, aviation, maritime, etc.
Specifically, in the documents regulating the functions, tasks, powers and organizational structure of the apparatus, these Departments all perform the same tasks, which are to advise the Minister on field management; draft and submit to competent authorities for promulgation of legal documents; develop plans, projects and strategies for the development of the sector... but in reality, their legal status is completely different. Accordingly, since its establishment, the Vietnam Register has had to implement a regime of autonomy and self-responsibility in performing its tasks, in its organization, personnel and finance.
“This Department has never been granted a civil servant status. Salaries and benefits for employees here are implemented according to the mechanism of a… business. This is an unreasonable existence, a difference between the Department of Registration and the remaining specialized Departments in the ministry,” Deputy Minister of Transport Nguyen Xuan Sang confirmed to PLVN.
The basic difference between a civil servant working at a state management agency and an official in a public service unit is that civil servants receive salaries provided by the state budget, while officials do not.
In fact, up to this point, the Vietnam Register has no state budget, or in other words, this unit is financially autonomous. If so, how are the positions such as Director, Deputy Director, Department-level leaders, etc. "identified" here, and what is their legal status in a state management agency under the Ministry of Transport?
“Although the positions of the Registration Department are not in the civil service payroll, the procedures, standards, and conditions for appointment or transfer all comply with the regulations of the Ministry of Transport on personnel organization. In short, the recruitment and appointment of personnel - procedures are no different from those of a civil servant or civil servant holding a leadership position in other Departments and Bureaus under the Ministry,” said Deputy Minister Sang, adding that the Ministry of Transport has been coordinating with the Ministry of Home Affairs to soon clearly and correctly determine the legal status of the personnel here.

State management department
It is known that, in addition to the procedures to be able to "return the name to the child", the Ministry of Transport also directed the reorganization of this Department in the direction of separating the state management function of vehicle inspection from the function of providing public services, in order to improve service quality, save social costs, ensure publicity, transparency and fair competition of vehicle inspection service providers.
It is expected that the Registration Centers under the Department will be responsible for providing public services; the Registration Department and some Registration Sub-Departments under this Department will only perform state management functions like the operating model of the Vietnam Maritime Administration, the Vietnam Aviation Administration, etc. However, the organization of the Vietnam Registration Department can be more compact and equivalent to the scale of the Vietnam Railway Administration.
Previously - in February 2023, after a series of Inspection Centers had to close, due to many leaders and inspectors at the centers and Inspection Sub-Departments under the Vietnam Register being prosecuted and temporarily detained, leading to a serious shortage of people doing professional and technical work, the Ministry of Transport at that time sent a document to the Ministry of Home Affairs allowing the Vietnam Register to sign labor contracts at its affiliated units until it recruited enough staff according to regulations.
Not long after that - in early March 2023, the Minister of Transport also transferred and appointed Mr. Nguyen Chien Thang - Director of the Department of Enterprise Management under the Ministry to be the Director of the Vietnam Register.
Since then, the Ministry of Transport has really taken steps to demonstrate its thoroughness in reorganizing the operating model of the Vietnam Register under the authority of the Ministry or making recommendations to competent authorities to promptly remedy the shortcomings after the shocking violations of this industry.
The Vietnam Register currently has 13 advisory organizations assisting the Director and 37 affiliated units. The financial management mechanism of the Department is applied according to the model of a single-member LLC with 100% of charter capital held by the State, in which the affiliated units account for themselves under the Department.
