For the past year, Lam Dong teachers, despite living in particularly difficult areas, have not received subsidies under Decree 76 because they are in new rural communes.

About 100 teachers in Da Tong commune, Dam Rong district, Lam Dong province have not received subsidies under Decree 76 (Decree 76/2019/ND-CP) for more than a year, since the commune was recognized as a new rural commune.
Loss of subsidy as soon as commune is recognized as new rural area
Decree 76 stipulates support policies for cadres, civil servants, public employees, workers and salaried people in the armed forces working in areas with especially difficult socio-economic conditions, including teachers.
According to the decree, officials, civil servants and public employees working in particularly difficult areas will receive a subsidy equal to 70% of their salary.
Many teachers in Da Tong commune reported that at the end of December 2023, the commune was recognized as a new rural commune.
And from January 2024, teachers working in the commune will no longer receive subsidies under Decree 76.
The district has different views from the department.
Regarding this issue, a representative of the People's Committee of Dam Rong district discussed: Decision No. 861/QD-TTg dated June 4, 2021 of the Prime Minister stipulates: "Communes in region III and region II approved in this decision, if recognized as meeting new rural standards, will be identified as communes in region I and will no longer enjoy policies applicable to region III and region II from the date of the decision".
Accordingly, the People's Committee of Dam Rong district believes that Da Tong commune is no longer a commune in region III after being recognized as meeting new rural standards (December 2023). Therefore, from January 2024, teachers working in Da Tong commune will not receive subsidies according to Decree 76.
Different from the viewpoint of the People's Committee of Dam Rong district, in the response document of the Department of Home Affairs of Lam Dong province to the Department of Home Affairs of Dam Rong district dated December 25, 2024 on determining beneficiaries of subsidies under Decree 76, it stated: Although recognized as a new rural commune, cadres, civil servants and public employees in Da Tong commune are still entitled to subsidies under Decree 76 because Da Tong is an ethnic minority and mountainous area, an island commune with special difficulties.
The above document also states that Da Tong's hamlets are particularly disadvantaged hamlets, villages, hamlets, villages, etc. (collectively referred to as hamlets) according to the Prime Minister's decision. Article 2 of Decree 76 stipulates this content.
In a similar case in Kon Tum, the Ethnic Committee has provided guidance. Specifically, the Ethnic Committee stated: "For extremely disadvantaged villages and hamlets in communes in regions I, II, and III (including extremely disadvantaged villages in communes meeting new rural standards), they will continue to enjoy policies for extremely disadvantaged villages."
Mr. Nguyen Duc Vu - Deputy Director of Lam Dong Province Department of Home Affairs - said that the department will review information related to the incident to respond and guide the removal of content related to Decree 76.
1 school accepted, 4 schools not accepted
It is worth mentioning that in Da Tong commune, there are 5 schools of all levels, but only teachers of Da Tong High School receive subsidies according to Decree 76, while teachers of the other 4 schools do not receive them.
According to Tuoi Tre Online , Da Tong High School is under the management of the Department of Education and Training of Lam Dong province. The department has issued a document with instructions similar to the Department of Home Affairs of Lam Dong province and confirmed that Da Tong commune is a new rural commune but still applies the subsidy policy from Decree 76.
The remaining schools are under the management of the Department of Education and Training of Dam Rong district. A social worker teacher in Da Tong commune shared: “We just don’t understand why, as teachers in the same area, some schools have support and some don’t.”
