On September 18, a source from the authorities said that the Department of Planning and Investment of Phu Yen province has just issued a document advising the People's Committee of this province regarding the Dac Loc Hotel project in the "golden land" area of Tuy Hoa city.
This project is in the list of projects attracting investment in the province since 2018, with Dac Loc Seafood Company Limited as the investor, with a total capital of about 200 billion VND (as of 2018).
According to sources, through review and dialogue with investors, many procedures related to land rental payment, land allocation and investment policy issuance are not in accordance with legal regulations.
In the minutes of dialogue between Phu Yen Provincial People's Committee and Dac Loc Seafood Company Limited about the Dac Loc Hotel project (July 24, 2024), it was determined that a number of provincial authorities had advised the Provincial People's Committee about this project in violation of regulations.
Specifically, the Department of Natural Resources and Environment advised the Provincial People's Committee to issue a document dated December 23, 2016 allowing the Dac Loc Seafood Private Enterprise (now Dac Loc Seafood Company Limited) to temporarily pay 50% of the land rent at once for the entire rental period before the decision to lease the land and the decision to approve specific land prices by the Provincial People's Committee.
Phu Yen Provincial Tax Department issued 2 notices of temporary payment of land rent (in 2016 and 2017) and the investor paid to the State budget a total amount of 26,422 billion VND.
The issuance of the above documents by State agencies does not ensure compliance with the procedures prescribed by the law on land, so it is necessary to have a plan to handle and return this amount to investors.
Regarding the adjustment of the investment policy decision for the Dac Loc Hotel project, the Department of Planning and Investment of Phu Yen province affirmed that there is no basis for resolution.
The reason for the origin of land use by households and individuals using land in the project area is that households encroached on State land, which is not in accordance with land use planning, so they are not eligible for land use right certificates.
In addition, within the project's land area, there is unused flat land managed by the People's Committee of Ward 9 (Tuy Hoa City), which is eligible to be separated into an independent project for commercial and service purposes. This area is subject to land use rights auction according to regulations. Previously, the decision on project investment policy without auctioning land use rights was not guaranteed according to regulations.
The Department of Planning and Investment proposed that the People's Committee of Phu Yen province promptly refund the amount the investor had temporarily paid according to regulations. After that, the relevant agencies worked with the investor to terminate the project.
