
Persistent entanglement
Reporting on administrative boundary issues, a representative of the People's Committee of Quang Nam province said that there have been long-standing issues between Tra Vinh commune, Nam Tra My district and Dak Nen commune, Kon Plong district (Kon Tum province).
Tra Vinh commune has 472 households and 1,998 people living stably for generations in the area of 3 villages (after rearrangement and merger).
When establishing records and maps of administrative boundaries according to Directive 364, problems arose regarding administrative boundaries and administrative lines according to Directive 364 not matching the actual management, cultivation and living conditions in the locality.
According to records and map of the 364th National Assembly, the entire village 3 with 238 households, 1,034 people (100% ethnic minorities) including 7 villages are living and farming in the territory of Dak Nen commune, Kon Plong district.
The farthest residential area from the DHHC road according to Directive 364 is about 8km and the closest from the DHHC road 364 is 4km. The total area of the overlapping area is more than 6,198ha of natural land, with the total length of the entangled route being more than 10km. The actual area of the area where residents of Tra Vinh commune (Nam Tra My district) live is delineated as 3,001.6ha.
From 2008 to 2021, the sectors and localities of Quang Nam province have repeatedly organized meetings with relevant sectors and localities of Kon Tum province but have not yet agreed on a solution. After many meetings, the leaders of the two provinces agreed to request the Ministry of Home Affairs to report to the Government to take the lead in resolving the issue.

Quang Nam Provincial People's Committee has issued Report No. 08, dated January 10, 2022, Official Dispatch No. 840, dated February 15, 2022, continuing to recommend the Ministry of Home Affairs to report to the Government to take the lead in resolving the problems between Quang Nam province and Kon Tum province.
On August 18, 2022, the Standing Committees of the Provincial Party Committees of the two provinces held a meeting and agreed to establish an interdisciplinary working group of the two provinces to collect public opinions and conduct field surveys in the overlapping area.
An interdisciplinary survey of the two localities of Quang Nam - Kon Tum was organized at the end of 2022. As a result, more than 99% of households in Tra Vinh commune requested to adjust the administrative division of the area of village 3, Tra Vinh commune (the part located in Dak Nen commune, Kon Plong district) to Tra Vinh commune.
Measure... in the room, no field testing
Also according to information from the People's Committee of Quang Nam province, when preparing the dossier according to Directive 364 of 1994, the unit that constructed the dossier and map of the General Department of Land Administration - Surveying Enterprise 204 under the General Department of Land Administration, measured and drew the map using the method of transferring internal drawings in the room and did not conduct a field inspection.
Also in Official Dispatch No. 101, Quang Nam requested the Central Government to adjust the administrative division of the natural area (the surveyed area is 789.6 hectares) of the area where 97 households of Village 1, Tra Giap Commune are living in Tra Thanh Commune, Tra Bong District, Quang Ngai Province, to Tra Giap Commune, Bac Tra My District, Quang Nam Province for management.
At the time of implementing Directive 364, measuring equipment and machinery were still rudimentary, had large errors, and measurement results were not highly accurate; officials and civil servants in mountainous areas had limited qualifications and were subjective in the work of inspecting and supervising the creation of records and maps.
“For these reasons, after implementing Directive 364, many localities have DHHC roads that are different from the long-standing living and farming practices of the people. In reality, 238 households of Tra Vinh commune living, farming, and burying graves in Dak Nen commune, Kon Plong district, Kon Tum province have lived, farmed, and buried graves before the establishment of records and maps according to Directive 364. This is an objective reality that has existed for a long time, not shifting cultivation or nomadic life” - Official Dispatch No. 101 dated May 23, 2024 sent to the Ministry of Home Affairs by the People's Committee of Quang Nam province affirmed.

Compared with the purpose of Project 513 in Decision No. 513, dated May 2, 2012 of the Prime Minister: "Resolve land disputes related to administrative boundaries at all levels left over from history and new ones arising from errors in the process of preparing dossiers and maps of administrative boundaries at all levels in accordance with Directive No. 364, dated November 6, 1991 of the Chairman of the Council of Ministers (now the Prime Minister) on resolving land disputes related to administrative boundaries at provinces, districts and communes"; the tasks of the People's Committees of the provinces are clearly stated: Coordinate with relevant central and local ministries, branches to organize consultation conferences and agree on administrative boundaries in areas of land disputes related to administrative boundaries at all levels; resolve points of inconsistency between the current management boundaries and the boundaries on the dossiers and maps of administrative boundaries".
According to Vice Chairman of the Provincial People's Committee Ho Quang Buu, in order to ensure the objectives and tasks of Project 513 as prescribed, and at the same time resolve difficulties in management and investment in infrastructure serving people's lives arising from problems with administrative procedures, Quang Nam continues to request the Ministry of Home Affairs to preside over organizing work to completely resolve the above-mentioned problems with administrative procedures.
From the management and living practices from the past until now and the wishes of the people in the area with problems regarding the administrative division (through many times of organizing to collect opinions), Quang Nam province proposed to adjust the actual area of the area where Tra Vinh commune residents live with an area of more than 3,000 hectares belonging to Dak Nen commune (Kon Plong district, Kon Tum province) to Tra Vinh commune (Nam Tra My district).
Quang Nam requests extension of project 513
In Official Dispatch No. 101, dated May 23, 2024, sent to the Ministry of Home Affairs, the People's Committee of Quang Nam province said that resolving problems related to administrative procedures is a difficult issue, and the locality has proactively organized working delegations to work with provinces with overlapping administrative procedures.
However, there is still no consensus among localities. The People's Committee of Quang Nam province has repeatedly made written recommendations and reported directly at working sessions and conferences; however, the problem of administrative procedures has not yet been resolved by the Ministry of Home Affairs.
Quang Nam Provincial People's Committee requested the Ministry of Home Affairs to recommend the Government to allow the extension of the construction period of Project 513 in provinces that have not yet completed resolving problems related to provincial-level DHHC roads, including Quang Nam.
