At the end of July 2024, Mr. LVT, in Nghia Tan ward, submitted a dossier to change the land use purpose from perennial crop land to residential land at the one-stop department (BPMC) of Gia Nghia City People's Committee. Mr. T's dossier was received and clearly stated the processing time as 15 working days (results returned on August 16, 2024).
When the deadline came, Mr. T went to the Gia Nghia City People's Committee's Office to receive the results of the application, but the staff there replied that there were no results yet. Many times after that, he went to the Office and continued to receive the same answer.

Mr. T said that the Gia Nghia City People's Committee did not comply with the provisions of the law. In early September 2024, Mr. T submitted a petition to the Chairman of the Gia Nghia City People's Committee complaining that his application was not processed.
Similar to the above case, Ms. NTN filed a dossier to change the land use purpose from agricultural land to residential land on a plot of land in Nghia Duc ward, Gia Nghia city. Ms. N submitted the dossier to the Gia Nghia City People's Committee's BPMC in June 2024 but it has not been resolved yet.
The application for change of land use purpose was not resolved, making the above two cases very upset. Because the land plot they requested to change its purpose was in accordance with the land use planning and the city's land use plan for 2024.

After receiving and meeting the deadline for resolution (15 working days), Gia Nghia City People's Committee did not resolve and specifically respond to them in writing.
These are just two of many cases that are slow to be resolved at the Gia Nghia City People's Committee. According to a leader of the Gia Nghia City People's Committee, the number of land use conversion cases submitted to the city's BPMC and not yet resolved has reached hundreds of sets.
Although Gia Nghia City People's Committee really wants to resolve these files so that people can fulfill their financial obligations and increase land use revenue.
In 2024, Gia Nghia City People's Committee was assigned to collect 100 billion VND from land use conversion fees. As of September 6, 2024, the whole city has collected more than 40.5 billion VND.
According to the Department of Natural Resources and Environment of Gia Nghia City, the conditions for changing the land use purpose are that it must be consistent with the planning and land use plan and the people have the desire (application for change). There are many cases that meet all the above conditions but the city has not been able to resolve them.
Because at the end of April 2024, Dak Nong Provincial People's Committee issued Decision No. 522 on approving the 2024 land use plan of Gia Nghia City.

In Clause 8, Article 2, Decision 522 states: “...for locations that are required to have detailed planning but have not yet been established, the People's Committee of Gia Nghia City is only allowed to implement the 2024 land use plan after the detailed planning is approved by the competent authority”.
Through inspection, the Department of Natural Resources and Environment of Gia Nghia City determined that there were many plots of land that had not been planned in detail, so there was no basis to advise the City People's Committee to allow the change of land use purpose.
However, the specialized department did not advise the Gia Nghia City People's Committee to issue a document to return the file, stop processing, or specifically notify the people.

Vice Chairman of Gia Nghia City People's Committee Thach Canh Tinh said: Decision 522 is causing difficulties for the city in resolving the issue of land use purpose change for the people.
The city has invited the Department of Construction and the Department of Natural Resources and Environment to work and provide specific instructions to submit to the Provincial People's Committee to adjust Decision 522. While waiting for the province to adjust, the city will have a specific written response to the people about the unsettled records.
