On behalf of the Government, the Prime Minister commended and highly appreciated the drastic participation of local Party committees and People's Committees of provinces and cities in the Mekong Delta region, who have proactively coordinated with the Ministries of Transport, Natural Resources and Environment, Construction, Planning and Investment, Agriculture and Rural Development, Finance and relevant ministries and branches to basically have a plan to remove difficulties and obstacles for highway projects, especially regarding the source of sand materials for filling roadbeds, as well as promoting the implementation of projects using ODA capital and foreign preferential loans in the area.

To promptly resolve difficulties and obstacles and speed up project implementation, ministries, branches and localities are requested to proactively and resolutely resolve assigned tasks according to their authority and legal regulations; focusing on implementing a number of tasks.

Specifically, the Ministries of Planning and Investment, Finance, Construction, Natural Resources and Environment, especially the Ministry of Transport and the provinces and cities assigned as project management agencies, focus on directing and requiring the Project Management Board, supervision consultants and contractors to promote the highest sense of responsibility, implement projects to ensure progress, quality, safety, technical and aesthetic standards, and maintain environmental sanitation; mobilize human resources and modern machinery and equipment to construct as quickly as possible; strictly comply with technical requirements and relevant legal regulations during project implementation.

Seriously implement 6 requirements

In particular, seriously implement the following 6 requirements: (i) Ensure quality, progress, safety, technical - aesthetic, ecological environment; (ii) Do not increase capital unreasonably; (iii) Do not divide the bid package; (iv) Fight corruption, negativity, group interests, waste at all stages; (v) Ensure the legitimate rights and interests of the People, ensure the harmony of interests of the State - people - enterprises; (vi) Timely reward collectives and individuals who do well and strictly handle violations (if any) in accordance with the law.

For localities, the Prime Minister requested that the Secretary of the City Party Committee and the Provincial Party Committee directly direct according to their authority; the government take part proactively, actively, regularly inspect, both develop plans and programs, mobilize the entire political system to monitor, manage quality, and speed up progress; direct investors, especially leaders, to closely follow reality, closely follow projects, be resolute in operating, managing quality, progress, and investment capital throughout the project implementation process, ensuring that projects are completed on schedule and ahead of schedule; pay special attention to resettlement work to stabilize people's livelihoods and production in new places of residence that are equal to and better than the old places of residence.

Relevant ministries and branches coordinate with the Ministries of Planning and Investment, Finance, Construction, Natural Resources and Environment, Transport and People's Committees of provinces and cities where the project passes to promptly complete assigned tasks on site clearance, resettlement, appraisal of component projects...; continue to create favorable conditions, promptly remove difficulties and obstacles, overcome all challenges to implement the project, and control progress.

Contractors urgently mobilize maximum human resources and construction equipment to ensure progress, efficiency, safety, and technical and aesthetic standards; consulting units enhance their responsibility, work professionally and independently, regularly inspect and supervise to ensure safety, quality, and progress; absolutely do not seek personal gain, do not lower standards, lower the quality of supervision, actively prevent and combat corruption, negativity, and waste...

Soon issue a Resolution allowing the application of the re-lending rate of foreign loans

For projects using ODA capital and foreign concessional loans, at present, there is still much room for further expansion and greater flexibility in borrowing ODA capital and foreign concessional loans because public debt, government debt, national foreign debt, and state budget deficit are well controlled according to the Resolution of the National Assembly. This is also an important source of capital, along with state budget capital and private capital to ensure the completion of socio-economic development goals; in the Mekong Delta alone, ODA projects play an important role in sustainable development, responding to climate change, preventing landslides, droughts, saltwater intrusion, and high tides.

The Government agreed to soon issue a Resolution to allow the application of a 10% re-lending rate of the Government's foreign loans for projects under the expenditure tasks of the provincial and centrally-run city budgets in the Mekong Delta region according to Resolution No. 120/NQ-CP dated November 17, 2017 of the Government. Localities in the region need to carefully study, calculate, and select projects using ODA capital and preferential loans that are necessary, effective, and in accordance with regulations, and that fight corruption, negativity, waste, and group interests.

Applying a financial mechanism to allocate 100% of foreign loans for a number of investment projects to build bridges connecting localities of an inter-regional nature.

To prepare well and effectively for new projects, remove obstacles, promote disbursement of public investment capital and ODA capital in the Mekong Delta, it is necessary to correctly identify the situation, achievements, limitations, difficulties, and challenges, requiring ministries, branches, and localities to focus on the following tasks:

- The Chairmen of the People's Committees of provinces and cities in the Mekong Delta region need to resolutely direct relevant departments and branches to urgently review and complete project proposal documents according to regulations; develop plans and closely monitor the progress of plan implementation; review and assign project implementation tasks to project management boards and investors with sufficient capacity and experience and coordinate with ministries, branches and sponsors to implement the project immediately after completing investment procedures according to regulations of law.

- To ensure investment efficiency, connectivity in the Mekong Delta region, and connection of coastal routes between localities, agree in principle to apply a financial mechanism of allocating 100% of foreign loans for a number of investment projects to build connecting bridges between localities of an inter-regional nature under the spending responsibility of the central budget. The Ministry of Planning and Investment shall preside over and coordinate with the Ministry of Finance, the Ministry of Transport and relevant localities to determine the list of these projects, report to the Prime Minister to assign the Ministry of Transport as the competent authority, to implement procedures for the projects, ensuring compliance with the provisions of the State Budget Law and other relevant legal provisions.

- The Ministry of Planning and Investment shall preside over and coordinate with the Ministry of Finance and relevant localities and agencies to continue mobilizing non-refundable aid sources; review and discuss with development partners to simplify and harmonize processes and procedures according to donor requirements and Vietnamese law provisions, and minimize administrative procedures.

- The Ministry of Foreign Affairs shall preside over and coordinate with the Ministry of Finance, the Ministry of Planning and Investment, the Ministry of Justice and relevant agencies to review the difficulties of the 2016 Law on International Treaties in the process of negotiating, signing and amending ODA loan agreements and foreign preferential loans to propose competent authorities to consider and amend (if any); report to the Prime Minister in August 2023.

The Prime Minister assigned Deputy Prime Minister Tran Hong Ha to directly direct ministries, branches and localities to coordinate the source of sand materials for filling roadbeds for key transport projects (including projects in the Mekong Delta), focus on accelerating the progress of research on plans and early conclusions on using sea sand as roadbed materials, avoid projects being behind schedule due to lack of filling materials, study the plan to build overpasses for expressways instead of building roads on dirt; assigned Deputy Prime Minister Tran Luu Quang to direct solutions to promote the implementation of ODA capital and foreign preferential loans to ensure efficiency and compliance with regulations.

Cao Lanh - An Huu Expressway: Project investment proposal submitted in July 2023.

Regarding the Cao Lanh - An Huu Expressway Project, the People's Committee of Tien Giang province agreed with the People's Committee of Dong Thap province to direct the project investor to closely coordinate with the Ministry of Transport to urgently complete the dossier and submit it to the Prime Minister to adjust the project investment policy in July 2023.

The Ministry of Planning and Investment balances the central budget to report to competent authorities for consideration of support for the additional funding for the Project in accordance with the provisions of law.

Can Tho - Ca Mau Expressway: Immediately implement procedures for direct handover of material mines to contractors

With the Can Tho - Ca Mau Expressway Project, the People's Committees of the provinces and cities: Can Tho, Hau Giang, Soc Trang, Bac Lieu, Kien Giang, Ca Mau focus on resolving problems related to the relocation of technical infrastructure works, especially the relocation of high-voltage power lines... to hand over the entire site to the investor in July 2023.

The People's Committees of An Giang, Dong Thap and Vinh Long provinces resolutely direct local departments and branches to, based on the guidance of the Ministry of Natural Resources and Environment, immediately implement procedures for directly handing over mines to contractors for exploitation in accordance with the provisions of law, without causing administrative procedures and without affecting the project progress. The Ministry of Transport and the Ministry of Natural Resources and Environment shall inspect, monitor and urge, and if there are any problems, report directly to the Prime Minister.

The People's Committee of Vinh Long province will complete procedures to hand over 02 material mines for contractors to carry out procedures in July 2023 and prioritize handing over the remaining mines to contractors for project exploitation, ensuring the supply of 5 million m3 of sand for filling in 2023; The People's Committee of An Giang province will promptly consider and have a specific plan to provide the remaining volume of 2024, ensuring enough volume of sand for filling in the Project.

Chau Doc - Can Tho - Soc Trang Expressway: Ensuring completion and handover of the entire site in the third quarter of 2023

As for the Chau Doc - Can Tho - Soc Trang Expressway Project, the sub-project investor will closely follow the progress of site clearance to carry out related work in accordance with legal regulations, ensuring the completion of handover of the entire site in the third quarter of 2023 (no later than December 31, 2023).

The People's Committee of Can Tho City and Hau Giang Province will immediately work with the People's Committee of An Giang Province to specifically determine sufficient sand sources for filling the roadbed for component project 2 and component project 3, and complete exploitation procedures in the third quarter of 2023.

The Prime Minister assigned the Government Office to preside over monitoring and urging ministries, branches and localities to implement the Prime Minister's direction in this notice, synthesize and report at the meetings of the State Steering Committee on important national projects and key works of the transport sector.
