Regarding the information that the Standing Committee of the Ca Mau Provincial Party Committee directed to re-arrange jobs for inspectors who were wrongly dismissed, on January 26, according to a source of Thanh Nien reporter, the Ca Mau Provincial Inspectorate implemented the decision to restore the job position of Mr. Le Duc Toan (former civil servant of the Inspection, Complaints and Denunciations Resolution Department 2 of the Ca Mau Provincial Inspectorate).

At the same time, deploy the withdrawal and cancellation of Decision No. 94/QD-TT dated September 6, 2022 of the Provincial Inspectorate on the dismissal of Mr. Toan.

That was the development in the process of Mr. Le Duc Toan complaining to the Ca Mau Provincial Federation of Labor (CLF) about the Chief Inspector of Ca Mau Province classifying him as not completing his tasks in 2020 and 2021, which was not in accordance with regulations.

After many revisions to the decision to discipline the inspector, more than 1 year later, on December 30, 2021, the Chief Inspector of Ca Mau province issued Decision No. 104/QD-TT to revoke and cancel the disciplinary decisions.

Accordingly, at 8:00 a.m. on August 19, 2022, the Ca Mau Provincial Federation of Labor organized a dialogue with the leaders of the Provincial Inspectorate, representatives of the Provincial Inspectorate's grassroots trade union, and Mr. Toan. By the afternoon of the same day (August 19, 2022), the Chief Inspector of Ca Mau Province signed a notice of dismissal for Mr. Toan.

On October 31, 2022, the Standing Committee of the Labor Federation sent a petition to the Chairman of the Provincial People's Committee to direct the Provincial Inspectorate to ensure compliance with legal regulations to protect the legitimate rights and interests of union members and provincial inspectors. Specifically, it requested the Provincial Inspectorate to review the 2020 civil servant evaluation results for Mr. Toan, because the basis for the evaluation was Decision No. 84/QD-TT dated December 10, 2020 (the decision to discipline Mr. Toan) which was annulled and re-evaluated according to Decree 90 dated August 13, 2020 of the Prime Minister.

In addition, review the results of the 2021 civil servant evaluation for Mr. Toan to see if it is in accordance with the regulations on evaluating civil servants of the provincial inspection agency. If there is not enough basis to evaluate that he did not complete his tasks according to Article 11 of Decree No. 90/2020/ND-CP, it must be transferred to the evaluation according to Article 10 of the above Decree.

After nearly 1 month of notice of dismissal, on September 6, 2022, the Chief Inspector of Ca Mau province signed a decision to dismiss Mr. Toan because for 2 consecutive years (2020 - 2021), he was classified as not completing his tasks.

Warned and fired for reporting to the Chairman of the Provincial People's Committee?

Mr. Le Duc Toan is the person who sent reports twice to the Chairman of the People's Committee of Ca Mau province, stating that Inspection Team No. 74 of the Ca Mau Provincial Inspectorate (inspecting the management and use of the Health Insurance Fund, purchasing medical equipment and supplies, and bidding for medicines in Ca Mau province from January 2014 to September 2019, of which Mr. Toan was a member) had many violations during the inspection process. From there, according to Mr. Toan, it led to the inspection conclusion (KLTT) No. 03/KL-TT dated May 25, 2020 not being consistent with objective reality, showing signs of violating the law.

Both times Mr. Toan sent reports, the Chairman of the Provincial People's Committee directed the Provincial Chief Inspector to verify and clarify the content. While the case was not investigated and verified by the Chief Inspector according to the direction of the Provincial People's Committee, the Head of Inspection Team No. 74 recommended a review of Mr. Toan.

Immediately afterwards, the Chief Inspector established a disciplinary council (Decision No. 70/QD-TT dated November 9, 2020) and on December 7, 2020, the Chief Inspector issued a disciplinary decision to reduce Mr. Toan's salary (Decision No. 77/QD-TT) for violating inspection activities.

After many revisions to the disciplinary decision against Mr. Toan, more than 1 year later, on December 30, 2021, the Chief Inspector issued Decision No. 104/QD-TT revoking and canceling the disciplinary decisions against Mr. Toan.

Next, on January 21, 2022, the Chief Inspector issued Decision No. 06/QD-TT to establish a disciplinary council to re-discipline Mr. Toan from the beginning and on February 23, 2022, decided to discipline Mr. Toan with a warning.

Previously, on November 23, 2021, Mr. Toan was disciplined by the Party Committee's Inspection Commission with a party warning for falsely reporting to the Chairman of the Provincial People's Committee the contents and activities of the Inspection Team... The Party Committee's Inspection Commission determined that Mr. Toan's violations had affected his personal reputation and the Inspection Agency of Ca Mau province.

Mr. Toan denounced the Chief Inspector of Ca Mau province for the same incident but disciplined him twice; 2 different forms of discipline and both times of discipline were not based on, applying any article or clause of Decree No. 112/20220/ND-CP; discipline exceeded the time limit prescribed by law.

The Chief Inspector's assessment and classification of Mr. Le Duc Toan as a civil servant in 2020 as not completing his duties was not in accordance with regulations (Disciplinary Decision No. 84/QD-TT dated December 23, 2020 was revoked and annulled, so the classification of the civil servant as not completing his duties was incorrect). In 2021, the classification of Mr. Toan as not completing his duties due to political and ideological degradation was incorrect.

The Standing Committee of the Ca Mau Provincial Party Committee believes that Mr. Toan's accusation is partly correct. Specifically, the Provincial Inspectorate issued a disciplinary decision exceeding the 150-day time limit prescribed by law, which is a correct accusation (the second disciplinary action was 591 days). The Provincial Inspectorate's assessment and classification of civil servant Le Duc Toan in 2021 as failing to complete his duties due to ideological degradation is not in accordance with the procedure.

Mr. Toan accused Inspection Team No. 134 of the Provincial Party Committee's Inspection Commission and Mr. Le Minh Y, Chairman of the Ca Mau Provincial Party Committee's Inspection Commission, of intentionally covering up for the Provincial Chief Inspector and failing to fulfill their role in protecting the position and job of the whistleblower.

After reviewing the content of the accusation reported by the inspection team, it was found that Mr. Toan's accusation was partly correct. In 2021, the Provincial Inspectorate classified civil servant Le Duc Toan as not fulfilling his duties due to signs of degradation in political ideology, ethics, lifestyle, self-evolution, and self-transformation, which was not in accordance with regulations. However, the Provincial Party Committee's Inspection Commission did not conclude that this content was incorrect.

The Standing Committee of the Ca Mau Provincial Party Committee directed the Provincial Inspector to restore Mr. Le Duc Toan's position, job title, reclassify civil servants, and re-enforce policies and regimes in accordance with regulations. At the same time, it directed the review of organizations and individuals with shortcomings and omissions in handling Mr. Toan's case.
