According to Article 31 of the draft Law on Personal Data Protection developed by the Ministry of Public Security, social networks and media service providers operating in Vietnam will not be allowed to ask users to provide photos of their CCCD or identity card to authenticate their accounts. Organizations and individuals providing the above services must be responsible for protecting citizens' personal data when operating or appearing on mobile application stores in the Vietnamese market.
CCCD photos may not be used to authenticate social media accounts under new bill
Not using a photo of the CCCD as a condition for identity verification when registering an account is to prevent the collection of unnecessary personal data, reducing the risk of abuse of users' personal information. The content of personal data must be clearly announced by the platform when the data owner installs (applications) and uses the service. Social networks are also not allowed to illegally collect personal data outside the scope of the agreement with users who have agreed to use the service.
In addition, the bill also states that eavesdropping, wiretapping or recording calls, or reading text messages without the consent of the data subject is a violation of the law.
Currently, the situation of illegal collection, purchase, sale and processing of personal data is widespread and complicated. Many businesses and organizations still collect personal data of users arbitrarily, exceeding the level necessary for business purposes. Notably, users often do not know clearly what their data is used for and to whom it is transferred, leading to a loss of control over personal information, causing risks to safety and privacy.
Public awareness of personal data protection is still limited as many people are willing to provide information in exchange for benefits and incentives without being fully aware of the potential risks. Current laws lack clear regulations on personal data protection, leading to widespread violations without strong enough measures.
The bill is expected to be discussed by the National Assembly at its 9th session next May and passed at the end of 2025.
