Removing obstacles for key programs and projects in the energy sector

The Government Office issued Notice No. 402/TB-VPCP on the conclusion of Deputy Prime Minister Tran Hong Ha at the Third Meeting of the State Steering Committee for important national programs, works and projects of the energy sector.

The announcement stated: Recently, ministries, branches, provincial People's Committees and corporations have actively implemented the direction of the Deputy Prime Minister, Head of the Steering Committee at the 2nd Meeting according to Announcement No. 117/TB-VPCP dated March 25, 2024 of the Government Office. Many tasks have been completed and handled and resolved; the progress of investment and construction of a number of projects, especially key and urgent projects, has achieved remarkable results such as completing and energizing the 500 kV line 3 projects from Quang Trach (Quang Binh) to Pho Noi (Hung Yen), removing difficulties and obstacles in the construction of cooling channels for Nhon Trach 3 and Nhon Trach 4 Thermal Power Plant projects, successfully negotiating with Power Machines on the Long Phu 1 project, etc.

However, there are still some difficulties and obstacles in the implementation of projects due to some inappropriate mechanisms and policies; the work of building, amending and supplementing legal documents is not timely; site clearance is slow and has encountered prolonged obstacles, etc.

To remove obstacles and create conditions to ensure project progress, the Deputy Prime Minister requested that in the coming time, ministries, branches, localities, relevant agencies and units, and members of the Steering Committee need to focus on thoroughly resolving difficulties and obstacles within their authority, speeding up the progress of projects to ensure energy security and socio-economic development of the country.

Create a legal corridor for investment projects

The Deputy Prime Minister requested that ministries and branches, according to their assigned functions and tasks, continue to proactively research, propose amendments and supplements to the Law, Decree and related legal documents, creating a legal corridor for investment, development of projects, especially the pilot project for offshore wind power development, handling of projects behind schedule, mechanisms for developing gas-fired power projects... Report to the Government for submission to the National Assembly for consideration on issues under the authority of the National Assembly in accordance with the provisions of law.

Ministries, branches, and provincial People's Committees shall proactively handle, within their authority, any difficulties or problems arising related to the state management functions of ministries, branches, and localities during the implementation of projects, proactively remove difficulties, and speed up the progress of projects. Report to the Government and the Prime Minister on issues beyond their authority.

On the development of power projects

The Deputy Prime Minister directed: Currently, all gas-fired power projects have common problems related to regulations on output commitment mechanisms and price mechanisms between electricity and gas. These are contents that have not been regulated in current legal documents under the jurisdiction of the National Assembly. The Prime Minister has assigned the Ministry of Industry and Trade to study and propose institutionalization to resolve problems arising in practice for gas-fired power projects during the drafting of the Electricity Law (amended) (Document No. 5045/VPCP-CN dated July 17, 2024 of the Government Office). If necessary, the Ministry of Industry and Trade shall promptly submit a law amending many laws to the Ministry of Planning and Investment for synthesis and reporting to the Government under the direction of Deputy Prime Minister Tran Hong Ha in Document No. 5185/VPCP-CN dated August 29, 2024 of the Government Office.

The Deputy Prime Minister requested the Ministry of Industry and Trade to promptly complete and soon issue a Circular amending and supplementing Circular No. 45/2018/TT-BCT dated November 15, 2018 of the Minister of Industry and Trade regulating the operation of the wholesale electricity market and a Circular amending and supplementing Circular No. 25/2016/TT-BCT dated November 30, 2016 regulating the power transmission system. If necessary, the Ministry of Industry and Trade shall coordinate with the Ministry of Justice to study, propose and report to the Prime Minister for permission to develop a Circular amending and supplementing Circular No. 25/2016/TT-BCT in a shortened form in accordance with the provisions of the Law on Promulgation of Legal Documents.

Ensuring the capacity of Nhon Trach 3 and Nhon Trach 4 thermal power plant projects is released by the end of 2025.

Regarding the Nhon Trach 3 and Nhon Trach 4 Thermal Power Plant Projects and the synchronous power grid projects to release the capacity of the plants, the Deputy Prime Minister assigned the Government Office to send a document to the Chairman of the Dong Nai Provincial People's Committee requesting direction to handle difficulties and obstacles in the site clearance work for the synchronous power grid projects to release the capacity of the thermal power plants. Strive to hand over the site in October 2024 to be able to complete the projects soon, ensuring the release of the capacity of the Nhon Trach 3 and Nhon Trach 4 Thermal Power Plant projects by the end of 2025.

Resolutely handle the difficulties of the Quang Trach 1 and Quang Trach 2 Thermal Power Plant projects

The Deputy Prime Minister assigned the People's Committee of Quang Binh province to direct the complete handling of difficulties and problems related to site clearance to create favorable conditions for the Investor in the construction of the Quang Trach 1 Thermal Power Plant project, ensuring progress according to the direction of the Prime Minister; promptly consider and approve the adjustment of the investment policy of the Quang Trach 2 Thermal Power Plant project according to regulations to implement the next steps.

Vietnam Electricity Group works with the People's Committee of Quang Binh province to soon complete site clearance work, and at the same time has a plan to speed up construction of items, ensuring the progress and quality of the Quang Trach 1 Thermal Power Plant Project; coordinates with the People's Committee of Quang Binh province in approving the adjustment of the investment policy of the Quang Trach 2 Thermal Power Plant Project.

Completing the Pilot Project for Offshore Wind Power Development

The Ministry of Industry and Trade shall preside over and coordinate with ministries, branches, corporations and enterprises to continue to urgently review, develop and complete the offshore wind power development pilot project according to the conclusions of Deputy Prime Minister Tran Hong Ha in Notice No. 42/TB-VPCP dated February 5, 2024, Notice No. 117/TB-VPCP dated March 25, 2024 and Notice No. 356/TB-VPCP dated July 30, 2024 of the Government Office.

The project needs to propose a specific project, investor and implementation time, from which to propose solutions and mechanisms and policies to ensure project implementation, including the stages of survey, exploration, assessment, planning, technology, and issues related to national defense and security, etc., and the competent authority will decide; then consider approving the investment policy, selecting investors, developing infrastructure, etc. The Ministry of Industry and Trade will study and report further on offshore wind power models, including models of cooperation with foreign countries, based on consulting opinions and recommendations from foreign organizations and investors to complete the project and report to the Government in September 2024.

Regarding the implementation of Power Plan 8, the Deputy Prime Minister requested the Ministry of Industry and Trade to implement the direction of Deputy Prime Minister Tran Hong Ha at the online conference with localities on promulgating supplements and updating the Power Plan 8 implementation plan according to Notice No. 396/TB-VPCP dated August 21, 2024 of the Government Office. In particular, the Ministry of Industry and Trade urgently coordinates with localities to review the list and send it to the Ministry of Public Security for comments on 154 projects that are still facing difficulties to synthesize and report to competent authorities for consideration and decision.

Regarding the handling of power source projects that are behind schedule and slow to implement, the Ministry of Industry and Trade shall preside over and coordinate with the Ministry of Planning and Investment and the Ministry of Justice to direct localities and investors to review and report specific statistics on each delayed project, the delay time, and the cause of the delay to synthesize and propose solutions and competent authorities for handling, including considering the project recovery plan in accordance with the provisions of law, and reporting to the Government and the Prime Minister before September 30, 2024.

Building a Project to ensure adequate electricity supply for the country in the coming period

The Ministry of Industry and Trade studies and develops a Project to ensure sufficient electricity supply for the country in the coming period. In particular, it calculates and forecasts electricity demand in the coming time, determines the structure of electricity sources, the impact of slow-progressing power source projects on electricity supply, proposes solutions (including the development of expanded hydropower projects, rooftop solar power projects, solar power projects on water surfaces, storage, and storage of electricity, if necessary, consider the option of developing small modular nuclear power combined with smart grids and smart regulation), and the mechanism for implementing projects (including specific mechanisms if necessary) to implement them synchronously and effectively, mobilizing resources from economic sectors (including clarifying the role of state-owned corporations in implementing projects) with the goal of ensuring sufficient electricity supply for the economy, reporting to the Government and the Prime Minister for consideration and decision in September 2024.
