The Ministry of Labor, Invalids and Social Affairs is consulting with ministries and branches to submit to the Prime Minister a proposal for the 2024 National Day holiday for officials, civil servants, public employees and employees of administrative agencies, political organizations, socio-political organizations (hereinafter referred to as civil servants and public employees) and employees of enterprises.
Option: Civil servants and public employees are given 2 days off according to regulations, including September 2 and the day immediately following National Day, September 3.
Specifically, with this plan, on the occasion of the National Day holiday in 2024, civil servants and public employees will have 4 days off, from Saturday, August 31, 2024 to Tuesday, September 3, 2024 (including 2 National Day holidays, one weekly day off and one compensatory day off for the weekly day off as prescribed in Clause 3, Article 111 of the Labor Code).
Option 2: Civil servants and public employees will have September 2 and one day off before National Day, which is September 1.
In particular, with this plan, civil servants and public employees will have 4 consecutive days off from Saturday, August 31, 2024 to Tuesday, September 3, 2024.
Although both options have 4 consecutive days off, the Ministry of Labor, Invalids and Social Affairs proposes option 1 for the 2024 National Day holiday because it has the advantage of reducing administrative procedures and not having to arrange weekly days off as prescribed in Clause 3, Article 111 of the Labor Code.
For employees, the Ministry of Labor, Invalids and Social Affairs requires that, based on actual conditions and holiday schedules for civil servants and public employees, employers arrange National Day holiday schedules for employees (employers are encouraged to apply holiday time for employees as prescribed for civil servants and public employees).
For the 2024 National Day holiday, the employer decides to give employees 2 days off (September 2 and the day before or after).
If the weekly day off coincides with the National Day holiday, the employer shall arrange a compensatory weekly day off for the employee on the next working day according to the provisions of Clause 3, Article 111 of the Labor Code.
Notably, in addition to the National Day holiday schedule, the Ministry of Labor, Invalids and Social Affairs also proposed a 7-day Lunar New Year holiday schedule.
In addition, according to the provisions of the Labor Code, employees are entitled to one day off for New Year's Day. In 2024, January 1 falls on a Monday, so employees are only entitled to one day off with full pay.
However, December 30 and 31, 2023 fall on Saturday and Sunday, so officials, civil servants, public employees and workers at state agencies will have a three-day holiday from December 30, 2023 to January 1, 2024.
For employees, one day off per week, New Year's holiday is 2 days, from December 31, 2023 to January 1, 2024.
Note: If the weekly day off coincides with the National Day holiday, the employer shall arrange a compensatory weekly day off for the employee on the next working day as prescribed in Clause 3, Article 111 of the Labor Code.
