For employees , the employer decides to choose the National Day holiday as Monday (September 2) and choose 1 of 2 days: Sunday (September 1) or Tuesday (September 3). Thus, for employees with a 1-day/week off falling on Sunday, the National Day holiday on September 2 will last 3 days from September 1 to September 3 if they choose to take the holiday on Sunday (September 1) or last 2 days from September 2 to September 3 if they choose to take the holiday on Tuesday, September 3. The National Day holiday plan for 2024 will be announced to employees at least 30 days before implementation. The Ministry of Labor, War Invalids and Social Affairs encourages employers to apply holiday leave for employees as prescribed for civil servants and public employees. According to the provisions of the 2019 Labor Code, employees who work overtime on holidays, Tet, and paid leave days will receive at least 300%, not including holiday, Tet, and paid leave wages for employees receiving daily wages. According to Article 104 of the 2019 Labor Code, bonuses are amounts of money or property or other forms that employers reward employees based on production and business results and the level of work completion of employees. Bonus regulations are decided by employers and publicly announced at the workplace after consulting with the organization representing employees at the workplace for places where there is an organization representing employees at the workplace. According to this provision, bonuses are not mandatory payments that employers must pay to employees. Thus, whether or not an employee receives a bonus on the occasion of National Day September 2nd must be based on the company's bonus regulations decided by the employer and publicly announced at the workplace after consulting with the representative organization of employees at the workplace for places where there is a representative organization of employees at the workplace. If there is no regulation in the bonus regulations for National Day September 2nd, the employee will not receive a bonus on this day. On the contrary, if there is a regulation, the enterprise will reward the employee in cash or in other forms.
