(Dan Tri) - According to new regulations of Dak Lak province, the minimum area for land division in communes is 60 square meters and in wards and towns is 40 square meters.
On October 26, the People's Committee of Dak Lak province officially issued a new decision related to the limits of some types of land, land use right papers before October 15, 1993, along with the conditions and minimum areas for land division and consolidation in this province.
According to the new regulations, land division must meet the following conditions: the land after division must have at least one side adjacent to a road or a canal with a bank combined with a road; not subject to land recovery; and consistent with the approved detailed construction plan.
For residential land, the minimum area for subdivision in communes is 60m2, with a minimum roadside edge of 4m and a minimum depth of 6m. In wards and towns, the minimum area is 40m2, with a minimum roadside edge of 3m and a minimum depth of 4m.
The regulation also clearly states that the minimum area does not include land belonging to the protection corridor, protection area, and construction safety belt. For commercial, service, and non-agricultural production land, land division is only allowed when the investment project is divided and separated according to the law.
For agricultural land, the minimum area after subdivision is 3,000m2 for forestry land and 1,000m2 for other types of agricultural land in communes, 500m2 in wards and towns.
Regarding land consolidation, adjacent land plots that meet the conditions of the 2024 Land Law will be allowed to be consolidated. If the land plots have different usage periods, the user can choose the shortest duration without adjusting the land usage period.
