Proposing to the Draft Land Law (amended) 2 contents on ensuring land for ethnic minorities

Questioning Minister and Chairman of the Ethnic Committee Hau A Lenh, National Assembly Deputy Tran Van Khai - National Assembly Delegation of Ha Nam province reflected on the shortcomings in land allocation for ethnic minorities to produce, including cases of land allocation to ethnic minorities but the land for production did not meet basic conditions, causing the ethnic minorities to be unable to produce and then abandon it; the situation of encroachment, sale, and transfer of land after being allocated... in the past. The delegate asked Minister and Chairman of the Ethnic Committee Hau A Lenh to clarify the causes, responsibilities of organizations and individuals for this situation and fundamental solutions. At the same time, does the Minister have any suggestions for the Draft Law on Land (amended)?

In response to this question, Minister and Chairman of the Ethnic Committee Hau A Lenh said that in reality, there are cases where people have been granted land but during the process of using it, people have transferred, bought, sold, donated... according to the provisions of the law. The transfer, buying, selling, donating... by people is in accordance with the provisions of the law and the local government also confirms it in accordance with the provisions of the law, except in cases where people transfer illegally, without the confirmation of the government.

However, in the process of resolving residential land and production land for ethnic minorities, some localities include the above cases. Therefore, localities need to carefully review the cases to ensure fairness in implementation.

Regarding the issue of responsibility for the above shortcomings, Minister and Chairman of the Ethnic Committee Hau A Lenh said that the laws on land, construction, urban areas, etc. have all been decentralized to localities, including the issuance of Certificates. Therefore, there needs to be coordination to thoroughly resolve the issue, such as: Central inspection and supervision; local inspection and handling. "When amending the Land Law and other related laws, there will be sanctions to better resolve this issue," said Minister and Chairman of the Ethnic Committee Hau A Lenh.

Regarding the proposal to contribute ideas to the Draft Law on Land (amended), Minister and Chairman of the Ethnic Committee Hau A Lenh, during the process of developing the Law on Land (amended), the Ethnic Committee also contributed ideas and sent a document to the Steering Committee, the Ministry of Natural Resources and Environment for synthesis. Accordingly, the Ethnic Committee proposed 2 clauses in Article 27 of the Draft: "There is a land policy for residential land and living land of ethnic minorities in accordance with the conditions, customs, cultural identity and actual conditions of each region" and "there is a policy to create conditions for ethnic minorities directly engaged in agricultural production in rural areas to have land for agricultural production".

Questioning Minister and Chairman of the Ethnic Committee Hau A Lenh, delegate Duong Tan Quan (Ba Ria - Vung Tau) stated that the lack of residential land and production land in ethnic minority areas has been a "painful" issue for many years but has not been completely resolved. From there, he asked the Minister to tell him about the advantages, difficulties and solutions in the coming time to resolve this situation.

Minister and Chairman of the Ethnic Committee Hau A Lenh said that there are still many households lacking residential land and production land. Through the review process, the demand for residential land is over 24 thousand households, and production land is 43 thousand households.

The Ethnic Committee has now conducted a feasibility study and submitted to the Prime Minister a plan to meet 60% of the housing needs of the people by 2025, and the remaining 40% in the 2026-2030 period. In particular, the focus is on solving housing for the most disadvantaged ethnic areas where people have not yet benefited from any policies.

Regarding production land, according to statistics, many localities have run out of land to allocate to ethnic minorities; some localities still have land to establish concentrated production areas for the people. Currently, the Government also has a policy to assign ministries, branches and localities to review the land fund of agricultural and forestry farms to reserve a part for ethnic minority people.

“Ministries, sectors and localities are implementing this but slowly. In the coming time, we, together with the ministries and sectors, will step up the review of this work,” said Mr. Lenh.
