Cost of donating and transplanting human tissues and organs
In the draft, the Ministry of Health proposed to add Article 33a on the cost of donating and transplanting human tissues and organs after Article 33 of the Law on Donating, Taking and Transplanting Human Tissues and Organs and Donating and Taking Cadavers as follows:
Costs for living donors of human tissues and organs include the following costs: Health examination for donors; checking biological parameters of donors; taking human tissues and organs; care and health recovery after donation.
Costs for people donating human tissues and organs after death for medical treatment include the following costs: Resuscitation; assessment of tissue and organ function for donation; collection of donated tissues and organs.
The costs for people who receive human tissue and body parts transplants include the following costs: Testing biological parameters; transplanting human tissue and body parts; health recovery; periodic re-examination and anti-rejection drugs. The draft clearly states that in cases where people who receive human tissue and body parts transplants receive human tissue and body parts from other medical examination and treatment facilities, in addition to the above costs, there are also costs for transporting human tissue and body parts.
Human tissue and organ transplant coordination unit
The Ministry of Health also proposed to add Article 36a on the unit coordinating human tissue and organ transplantation after Article 36 of the Law on Donation, Collection and Transplantation of Human Tissues and Organs and Donation and Collection of Cadavers as follows:
The head of the medical examination and treatment facility that is authorized to take and transplant human tissues and body parts shall decide to establish a unit to coordinate human tissue and body part transplantation.
The human tissue and organ transplant coordination unit has the following responsibilities:
- Receive and process information about donation, change or cancellation of donation of human tissues and organs at the facility;
- Manage the facility's waiting list for human tissue and organ transplants;
- Manage information related to donors and recipients of human tissue and organ transplants at the facility;
- Coordinate with the National Coordination Center for Human Organ Transplantation in coordinating the collection, transplantation, preservation, storage, and transportation of human tissues and organs between its facility and other medical examination and treatment facilities for human tissue and organ transplants;
- International cooperation in coordinating the collection and transplantation of human tissues and organs.
Donate blood and receive blood from donors
In the draft, the Ministry of Health also proposed adding regulations on blood donation and receiving blood from donors.
Specifically, blood donors must be between the ages of 18 and 60, have full civil capacity, and be in good health according to the regulations of the Minister of Health.
Blood donors must be consulted, have a health check-up and undergo necessary tests free of charge before blood is collected according to regulations of the Minister of Health. In case of ineligibility to donate blood, the medical staff receiving the blood must clearly explain the reason.
Receiving blood from donors must ensure the safety of the blood donor and comply with technical regulations on receiving blood from donors as prescribed by the Minister of Health.
Stem cell donation
The draft proposes the following conditions for stem cell donors: Meet the health requirements prescribed by the Minister of Health; be 18 years of age or older, and have full civil capacity. In the case of a stem cell donor who is between 9 and under 18 years of age, the consent of the parent or legal guardian and the person himself/herself regarding the stem cell donation must be obtained. In the case of a stem cell donor who is under 9 years of age or who has lost or has limited civil capacity, the consent of the parent or legal guardian regarding the stem cell donation must be obtained.
Stem cell donors must be consulted, have a health check-up and undergo necessary tests free of charge before stem cell collection in accordance with the technical procedures approved by the head of the stem cell receiving facility or the Minister of Health. In cases where the conditions for stem cell donation are not met, the medical staff receiving the stem cells must clearly explain the reasons.
According to the draft, stem cell donation can only be performed at the following facilities: 1- Medical examination and treatment facilities that have been permitted by the Ministry of Health to perform stem cell transplantation; 2- Medical examination and treatment facilities that have not been permitted by the Ministry of Health to perform stem cell transplantation but have a contract with a stem cell bank or a scientific and technological organization conducting stem cell research.
Rights and obligations of blood and stem cell donors
Benefits of blood and stem cell donors:
- Priority and free provision of blood equivalent to the amount of donated blood when there is a need to use blood during treatment at a State medical examination and treatment facility;
- Take half a working day off after the employer's consent to donate blood without deduction of salary or counting as vacation or holiday according to the provisions of labor law;
- Priority access to stem cell sources at stem cell banks when needed.
- Provided with information about blood-borne diseases;
- Be explained about the blood and stem cell collection process, possible unexpected complications, and tests that will be performed before and after donating blood and stem cells;
- Guaranteed confidentiality of clinical examination and test results; receive advice on abnormalities detected during health examination for blood and stem cell donation; receive instructions on how to take care of health after donating blood and stem cells;
- Receive care, treatment and support for care and treatment costs when unexpected complications occur during and after blood and stem cell donation;
Obligations of blood and stem cell donors:
- Provide truthfully and take responsibility for the information you provide regarding your health status before donating blood or stem cells;
- Comply with the instructions of medical staff during the screening and blood and stem cell donation process;
- Do not donate blood or stem cells if you are in a situation where you are not allowed to donate blood or stem cells after being advised by medical staff.
Stem cell bank
According to the draft, stem cell banks include stem cell banks within the organizational structure of medical examination and treatment facilities and stem cell banks with independent organizational structures belonging to the state or private sector.
Conditions for granting a license to operate a stem cell bank: Having human resources, medical equipment and facilities suitable for the type of stem cells the bank performs; having a quality management system that meets prescribed standards.
Scope of activities of stem cell bank:
- Receiving, preserving and storing stem cells;
- Transport and supply stem cells to medical examination and treatment facilities or research facilities, training facilities in the health sector;
- Supply and exchange stem cells with other stem cell banks;
- Applying culture methods to create embryonic stem cell sets or differentiate stem cells;
- Cooperate with foreign agencies, organizations and individuals in exchanging stem cells for the purpose of medical examination, treatment, training and medical research.
The Government shall specify in detail the conditions, authority, records, and procedures for granting licenses for stem cell banking operations and activities within the scope of stem cell banking.
