Kinhtedothi-Discussing the Draft Law on Trade Unions (amended), National Assembly deputies said that the 2% trade union fee contribution rate is appropriate, aiming to maintain activities to care for workers' lives. Along with that, there are still concerns that this contribution rate causes difficulties for businesses with many employees.
On the morning of October 24, at the 8th Session of the National Assembly, Chairwoman of the National Assembly's Social Committee Nguyen Thuy Anh presented a report on receiving, explaining and revising the Draft Law on Trade Unions (amended).
Foreign workers have the right to join the Union.
Basically, the Draft Law on Trade Unions (amended), after being absorbed and revised, has ensured the timely institutionalization of Resolution No. 02-NQ/TW dated June 12, 2021 on "Innovation of organization and operation of Vietnam Trade Unions in the new situation" and a number of policies and resolutions of the Party on trade union organizations and the working class.
The Draft Law has inherited the contents that have affirmed the rationality, stability and effectiveness in the implementation of the current Trade Union Law and amended some contents to meet practical requirements.
Regarding some specific contents, regarding the joining and activities of foreign workers in the Trade Union (stipulated in Article 5), taking into account the opinions of many National Assembly deputies and the opinions of competent authorities, the National Assembly Standing Committee directed the revision of the Draft Law in the direction of stipulating that "foreign workers working in Vietnam under labor contracts with a term of 12 months or more have the right to join the Trade Union and operate at grassroots trade unions".
In addition, Clause 5, Article 4 of the Draft Law stipulates that trade union officials are Vietnamese citizens, therefore, foreign workers cannot become trade union officials.
Regarding Trade Union supervision (Article 16 of the Draft Law), based on the opinions of National Assembly deputies and the proposals of the Drafting Agency, the National Assembly Standing Committee directed the revision of the provisions on Trade Union supervision rights in the direction of: separating the content of participation in supervision in Article 15 of the Draft Law to include it in Article 16 on Trade Union supervision.
The National Assembly Standing Committee also accepted the opinions of National Assembly deputies. The draft Law added Article 30 regulating cases of exemption, reduction, and suspension of trade union fee payment.
The 2% fee could be a hardship for businesses with many employees.
Discussing in the hall, concerned about the content of the Union fee paid by agencies, organizations, and enterprises at 2% of the salary fund as the basis for paying social insurance for employees, National Assembly delegate Nguyen Anh Tri (Hanoi delegation) said that the 2% funding level is no longer suitable for the current context.
The delegate said that paying the 2% union fee becomes a burden for businesses with a large number of employees. Therefore, the delegate proposed that for businesses with less than 500 employees, the union fee should be 2%. For businesses with 500 to less than 3,000 employees, the rate should be 1.5%. For businesses with more than 3,000 employees, the union fee should be only 1%.
Also interested in this content, National Assembly delegate Tran Nhat Minh (Nghe An province delegation) proposed to continue maintaining the union fee level of 2% and the regulation as in the Draft Law.
Delegate Tran Nhat Minh said that the Union funding source has been maintained and promoted effectively for over 60 years, since the Trade Union Law was enacted in 1957. This funding source is used at the grassroots Trade Union mainly to take care of the lives of union members and workers, such as visiting, sick leave, Tet gifts, birthday gifts... or organizing cultural and sports activities.
National Assembly delegate Nguyen Viet Ha (Tuyen Quang province delegation) said that the Draft Law currently does not regulate the distribution of trade union funds when there are many organizations representing workers. The lack of such regulations will lead to difficulties and obstacles in the implementation process in practice. Therefore, it is necessary to add the principle of distributing trade union funds to the Draft Law, in which it is necessary to enhance the responsibility of the General Confederation of Labor on this content.
Regarding the distribution of trade union funds, National Assembly delegate Leo Thi Lich (Bac Giang province delegation) suggested that the distribution of trade union funds when there are many organizations representing workers needs to be clearer - especially in the context of many organizations representing workers in enterprises.
According to the explanation and acceptance of the National Assembly Standing Committee, to be consistent with reality, the Draft Law has added a number of new expenditure tasks such as expenditures for grassroots trade unions where organizations and enterprises facing difficulties are exempted from or have their trade union fees reduced.
Union funds are also used to build social housing for workers to rent, build public works for union members, workers, and union institutions mainly from the accumulated union finances of the provincial, city and equivalent levels and the Vietnam General Confederation of Labor.
Union fees are included in deductible expenses when determining taxable income of the enterprise.
