The Trade Union Law (amended) consists of 6 chapters with 37 articles, an increase of 4 articles compared to the current Law and has some new points such as: Vietnamese workers working without labor relations in Vietnam have the right to establish, join and operate Trade Unions.
Supplementing the right to join and operate a Trade Union at the grassroots Trade Union (without the right to establish or become a Trade Union official) of foreign employees working in Vietnam.
At the same time, the Law also supplements the right to join the Vietnam Trade Union of employees' organizations at enterprises; clearly defines and distinguishes "Vietnam Trade Union" from "Vietnam General Confederation of Labor", and clearly stipulates 4 levels of trade unions.
Supplement the Trade Union's right to supervision and social criticism; supplement cases of exemption, reduction, and suspension of trade union fee payment and the Government shall regulate these cases after reaching agreement with the Vietnam General Confederation of Labor.
In addition, the Trade Union Law stipulates that the trade union fee will continue to be maintained at 2%. Along with that, the Law amends and supplements regulations to clarify the principles of management and use of trade union finances; amends and supplements expenditure tasks of trade union finances; supplements regulations on the Vietnam General Confederation of Labor to decentralize the collection and distribution of trade union funds...
The Law also adds the responsibility of the Vietnam General Confederation of Labor to periodically report to the National Assembly every two years on the situation of revenue, expenditure, management and use of trade union finances; adds the responsibility of the State Audit, every two years, to audit the management and use of trade union finances and to conduct ad hoc audits at the request of the National Assembly and the National Assembly Standing Committee.
Previously, presenting a report explaining, accepting and revising the draft Law on Trade Unions (amended), Chairwoman of the National Assembly's Social Committee Nguyen Thuy Anh said: continuing to maintain 2% of Trade Union funds aims to institutionalize the policy in Resolution No. 2-NQ/TW dated June 12, 2021 of the Politburo on innovation of organization and operation of Vietnam Trade Unions in the new situation is "Maintaining existing resources; collecting Trade Union funds and encouraging the socialization of resources for Trade Unions to perform well their assigned tasks".
According to the Chairman of the National Assembly's Social Committee, since the Trade Union Law of 1957, the Trade Union budget has been continuously implemented, maintaining the 2% revenue source of the trade union budget to mainly care for workers and ensure the activities of the Trade Union, demonstrating the superiority of the socialist regime;
On the other hand, the Union budget is mostly used at the grassroots level (currently 75%) to take care of union members and workers. The more workers a business has, the more funds it needs to take care of social welfare for workers - especially to take care of, represent, and protect the legitimate and legal rights and interests of union members and workers.
Therefore, the rate of Union contribution does not depend on the size of the enterprise, whether it has few or many workers. In addition, Union contribution is included in deductible expenses when determining the taxable income of the enterprise.
Along with that, maintaining the Union budget is also to encourage businesses and employers to be more responsible towards their employees through the Union. Therefore, the National Assembly Standing Committee proposed that the National Assembly keep the regulation on the union budget of 2%.
The Trade Union Law (amended) takes effect from July 1, 2025.
