National Assembly delegates propose that businesses with over 3,000 employees only pay 1% union fees

Discussing the revised Trade Union Law, National Assembly delegate Nguyen Anh Tri proposed flexible union fee payment levels according to the number of employees of each enterprise.


This level of funding is no longer reasonable in the current context.

This morning (October 24), continuing the 8th session, the National Assembly discussed in the hall the draft revised Trade Union Law.

The content of trade union fees paid by agencies, organizations and enterprises at 2% of the salary fund as the basis for social insurance contributions for employees is of interest to many delegates.

According to delegate Nguyen Anh Tri (Hanoi delegation), since 1957, maintaining the 2% union fund is reasonable. Because, the workers at this time were mainly officials and employees working in state agencies. The fund is allocated by the state.

However, Mr. Nguyen Anh Tri said that this level of funding is no longer reasonable in the current context. Specifically, currently, the number of enterprises in Vietnam is very large, the number of employees in enterprises is large, from several hundred, several thousand, even up to tens of thousands of people.

This delegate said that paying 2% union fees becomes a burden for businesses with many employees.

"If the situation becomes so serious that businesses cannot expand or even maintain operations, workers will lose their jobs; businesses will shrink, FDI investment will decrease, the country's economy will be affected, and workers will become unemployed," Mr. Tri worries.

To suit current conditions, Mr. Nguyen Anh Tri suggested that for businesses with less than 500 employees, the union fee rate is 2%. For businesses with 500 to less than 3,000 employees, this rate is 1.5%. For businesses with more than 3,000 employees, the union fee rate is only 1%.

In addition, the Hanoi City Delegation delegate said that the draft Law needs to have more regulations on businesses paying attention to the spiritual, cultural, sports and entertainment life of employees.

Delegate Tran Nhat Minh (Nghe An delegation) proposed to continue maintaining the union fee level of 2% and the regulations as in the draft law.

"The trade union fund has been maintained and effectively promoted for over 60 years, since the Trade Union Law was enacted in 1957. This fund is mainly used at grassroots trade unions to take care of the lives of union members and workers, such as visiting, sick leave, Tet gifts, birthday gifts... or organizing cultural and sports activities," said delegate Minh.

According to delegate Minh, the draft law has added some contents to suit the reality, such as regulations on suspending and exempting union fees for organizations and businesses facing difficulties, so when implementing this policy, revenue from union fees is expected to decrease.

However, at that time, the superior trade union still supports and protects the rights of union members and employees at the grassroots trade union in cases of temporary suspension or exemption from paying union fees.

"Therefore, legalizing and continuing to maintain the 2% union budget as stipulated in the draft law is extremely necessary, ensuring that unions fulfill their responsibilities to union members and workers, contributing to the stable development of agencies, units and enterprises," Mr. Minh analyzed.

2% union dues are not a burden for businesses

The report on receiving, explaining and revising the draft law by the National Assembly Standing Committee said that during the discussion, there were many opinions suggesting continuing to maintain the 2% trade union fee level.

Besides, there are some opinions that do not agree with this fee level and suggest that union funds should be contributed voluntarily by non-state organizations and enterprises.

This opinion also proposes not to collect 2% union fees from units that already have other employee representative organizations; stipulate a roadmap to gradually reduce the union fee rate and assign the Government to specify details.

Explaining, the National Assembly Standing Committee stated that since the Trade Union Law of 1957, trade union funds have been continuously collected. Maintaining the 2% revenue source of trade union funds to care for workers and ensure the operation of the trade union apparatus demonstrates the superiority of the socialist regime.

According to the National Assembly Standing Committee, this funding source also plays an important and decisive role in ensuring financial resources for Vietnam Trade Unions, especially grassroots trade unions, to perform their functions and tasks of caring for social welfare for workers; especially representing and protecting the legitimate and legal rights and interests of union members and workers.

To be consistent with reality, the National Assembly Standing Committee said the draft law has added a number of new spending tasks such as spending for grassroots trade unions where organizations and businesses facing difficulties are exempted from or have their trade union fees reduced.

Union funds are also used to build social housing for workers to rent, build public works for union members, workers, and union institutions mainly from the accumulated union finances of the provincial, city, and equivalent levels and the Vietnam General Confederation of Labor.

Union fees are included in deductible expenses when determining taxable income of the enterprise.

The National Assembly Standing Committee cited a report by the Vietnam General Confederation of Labor showing that trade union fees account for a small proportion of business expenses (on average about 0.38%) and that there are few proposals from businesses related to paying 2% of trade union fees.
