(Dan Tri) - In response to comments, the National Assembly Standing Committee revised the draft revised Trade Union Law to not regulate the distribution of trade union funds.
On the morning of October 24, the National Assembly discussed a number of controversial contents of the draft revised Trade Union Law.
Regulations on management principles
Regarding the distribution of trade union funds, there are opinions suggesting to consider not strictly regulating the distribution rate of trade union funds in the draft Law but instead regulating the "maximum" and "minimum" rates to ensure flexibility in regulating trade union funds.
However, there are also opinions suggesting to study and supplement regulations on principles in the management and use of trade union finances to ensure publicity and transparency.
On the other hand, there are opinions that the content of allocating union funds for union goals and activities needs to be clearly defined to serve as a basis for financial disclosure...
Based on the comments, the National Assembly Standing Committee directed the revision and implementation of the draft Law in the direction of supplementing regulations on the principles of management and use of trade union finances, and reviewing the tasks of spending trade union funds more fully.
Besides, the draft Law does not regulate the distribution of trade union funds to ensure flexibility and harmony.
This agency also directed the adjustment in the direction of adding the regulation that: "After agreeing with the Government, the Vietnam General Confederation of Labor shall prescribe standards, norms, spending regimes, decentralization of collection, distribution and management, and use of trade union finances in accordance with the requirements of the trade union's tasks".
The Government is assigned to detail the management and use of trade union funds of labor organizations at enterprises.
Maintain the 2% union fee regulation
In addition, many opinions proposed to continue maintaining the union fee rate of 2%; stipulate a roadmap to gradually reduce the union fee rate and assign the Government to specify details...
According to the National Assembly Standing Committee, since the Trade Union Law of 1957, trade union funds have been continuously implemented. The legalization and maintenance of the 2% trade union fund revenue source aims to take care of workers and ensure the operation of the trade union apparatus.
Continuing to maintain 2% of union funds aims to institutionalize the policy in Resolution No. 02.
This source of funding plays an important and decisive role in ensuring financial resources for Vietnam Trade Unions, especially grassroots trade unions, to perform their functions and tasks in caring for the social welfare of workers.
According to the National Assembly Standing Committee, this demonstrates the accompanying and coordinating with businesses and employers to care for the lives and welfare of employees, encourage and motivate employees to stick with the unit and also promote businesses and employers to be more responsible towards their employees through the Trade Union.
The Draft Law has added a number of new expenditure tasks to suit the reality such as: Expenditure for grassroots trade unions where organizations and enterprises facing difficulties are exempted or have their trade union fees reduced; expenditure for building social housing for workers to rent, building public works for union members, workers, and trade union institutions...
Union fees are included in the deductible expenses when determining the taxable income of the enterprise. At the same time, according to the report of the Vietnam General Confederation of Labor, union fees account for a small proportion of the enterprise's expenses (on average about 0.38%). Therefore, it can be said that the issue of 2% union fees is not a burden for the enterprise.
Therefore, the Standing Committee of the National Assembly requests the National Assembly to keep the regulation on the 2% trade union fee level.
