What is the cause of the 14 projects' problems?
In recent times, Quang Nam has witnessed the rapid development of housing construction investment projects. However, many projects have encountered difficulties in completing legal procedures related to granting Land Use Right Certificates (LURCs) to transferees.
Specifically, there are 14 real estate projects in Quang Nam that have completed infrastructure construction but have not yet been granted land use right certificates due to problems related to land price determination and financial obligations of investors.
The main cause of this problem comes from errors in determining land prices of projects. Previously, when determining land prices, there were errors leading to incomplete payment of land use fees and land rents. This resulted in projects being unable to fulfill their financial obligations and not being granted land use right certificates as prescribed.

For these 14 projects, many investors have made temporary payments or have plans to secure assets for additional payments of outstanding land use fees and land rents. However, the process of re-approving specific land prices has not been completed, causing the projects to fall into a "suspended" state, unable to issue land use right certificates to transferees.
Among the projects facing difficulties, there are notable projects such as Dong Na Service Urban Area and Vong Nhi Urban Area of Dat Phuong Hoi An Joint Stock Company; An Hoa Bay 2 Ecological Urban Area of FVGLAND Investment and Development Joint Stock Company. In addition, there are Thanh Ha Urban Area Phase 1 of ROYAL CAPITAL Group Joint Stock Company and Nui Thanh Town Residential Area (Phase 2) of An An Hoa One Member Co., Ltd.
For the Dien Nam Bac Market Quarter project of Dat Quang - Quang Nam Urban Development Investment Joint Stock Company and Truong Dong Residential Area of Quang Nam Urban Environment Joint Stock Company, Quang Nam province is also actively handling procedures to grant land use right certificates.
Important move of Quang Nam province to handle difficulties
Regarding this issue, on August 21, according to the Office of the People's Committee of Quang Nam province, Mr. Tran Nam Hung, Vice Chairman of the Provincial People's Committee, made important requests regarding the settlement of land division dossiers and the issuance of land use right certificates for housing construction investment projects in the province.
Under the direction of the Vice Chairman of the Provincial People's Committee, the Department of Natural Resources and Environment will continue to resolve the issuance of land use right certificates to project investors and handle the procedures for land division, registration of changes, issuance of land use right certificates, house ownership rights and other assets attached to land for transferees at 14 housing projects.
In particular, it is important to note that the maximum land area ratio does not exceed 90% depending on each specific project.
The Department of Natural Resources and Environment is also required to work closely with project investors to ensure written commitments and collateral to fully perform arising financial obligations.
These financial obligations include land use fees, one-time land rental payments, corporate income tax and registration fees on behalf of the land use right transferee.

Furthermore, investors need to commit to voluntarily comply and not file lawsuits or complaints when State agencies handle secured assets in case of non-performance or late performance of financial obligations for the difference (if any) according to the tax authority's notice after the specific land price is re-approved.
In addition, the Provincial Tax Department is responsible for closely coordinating with the Department of Natural Resources and Environment in guiding and requiring project investors to commit to securing assets and monitoring the re-approval of land prices of projects. The Provincial Tax Department needs to ensure that investors fully perform their arising financial obligations, in order to avoid loss of State budget revenue.
With the strong direction of the People's Committee of Quang Nam province, the difficulties in housing construction investment projects are gradually being resolved. However, to ensure that the projects are completed on schedule and do not affect the rights of the people, there needs to be close coordination between the authorities and the determination of the investors. Determination from both sides will be the key to help Quang Nam province continue to develop, meet the housing needs of the people and maintain socio-economic stability in the area.
