Regarding the amendment of Decree 178, in cases where lower policies and regimes have been resolved, compensation will be provided to ensure the rights of beneficiaries when restructuring the apparatus.
The Ministry of Home Affairs has a draft Decree amending and supplementing a number of articles of Decree No. 178/2024 of the Government on policies and regimes for cadres, civil servants, public employees, workers and armed forces in implementing the restructuring of the political system.
In addition to expanding the policy beneficiaries, the draft Decree on amendments and supplements on implementation.

Accordingly, cases eligible for policies and regimes according to the provisions of draft Decree No. 178/2024 that have been resolved by competent authorities for policies and regimes according to Decree No. 29/2023 of the Government (regulations on streamlining payroll) from January 1 will be compensated according to the new policies and regimes.
Cases that have been resolved by competent authorities on policies and regimes according to Decree No. 177/2024 of the Government (stipulating policies and regimes for cases of non-re-election, re-appointment and officials who quit or retire at will) from January 1 to before the effective date of draft Decree No. 178/2024, if the policies and regimes are lower than the prescribed policies and regimes, compensation will be provided according to the policies and regimes.
Draft Decree No. 178/2024 also clearly states that cases where competent authorities have decided to retire before the age limit before January 1 according to the provisions of Decree No. 21/2009 of the Government (detailing and guiding the implementation of a number of articles of the Law on Officers of the Vietnam People's Army on the regime and policies for officers who have stopped serving in the army; officers in service who have sacrificed or passed away; officers in service who have transferred to professional soldiers or defense civil servants); Decree No. 151/2016 of the Government (detailing a number of articles on the regime and policies of the Law on Professional Soldiers, Workers and Defense Civil Servants); Decree No. 32/2013 of the Government (detailing and guiding the implementation of a number of articles of the Law on Cryptography on regimes and policies for people working in cryptography) but from January 1, the competent authority has not issued a decision to resolve the regime and policies, the new policies and regimes are also applied.
In January, the Ministry of Home Affairs issued Circular 01/2025 guiding the implementation of policies and regimes for cadres, civil servants, public employees and workers in the implementation of organizational restructuring of the political system.
