It is worth mentioning that not only the Z121 factory’s pellet and flower spraying rigs but also strange types of fireworks in the shape of balls, nozzles, etc., commonly called “fireworks”, are being offered for sale. However, most of the posts selling fireworks do not list specific prices but require customers to send a private message. For some types with expensive prices, the seller may require customers to transfer a deposit before purchasing.
Posing as a person looking to buy fireworks for Tet, the reporter received enthusiastic advice from account M.D. This person said that the goods will be delivered to your hand just 2-3 days after placing the order. For flower spraying racks, the price is 480,000 VND. As for pellet spraying racks, the price is 400,000 - 900,000 VND/rack, depending on the number of racks: 36, 49... or 100.
According to the product images provided by the seller, many spraying rigs have strange foreign words. Many types even have no labels. This means that these are not genuine products of the Z121 factory under the Ministry of National Defense. The price is also 50,000 - 100,000 VND/rig higher than similar products of Z121.
“The Z121 firecracker is not available yet. But that firecracker is not as beautiful as this one. This firecracker shoots higher and blooms more beautifully than the Z121 firecracker,” the seller offered.
Although they are not fireworks business units under the Ministry of National Defense as regulated, many groups have still "sprouted up", with similar names such as "Tet Fireworks Z121", "Fireworks Playing Association Z121"... to guide consumers. In addition to product photos, some sellers also film videos of the fireworks burning process to increase the attractiveness when posting sales advertisements.
According to current regulations, individuals can only buy and use fireworks through agents in 56 provinces and cities nationwide and stores of Chemical Company 21 (Factory Z121) under the Ministry of National Defense. Each citizen is usually allowed to buy a maximum of 3 products at these stores.
Meanwhile, after PV was approved as a member of these groups, he saw that this place gathered many fireworks "traders" with dozens, hundreds of different products, all of which were openly advertised for sale, and people who wanted to buy as much as they wanted could buy.
Lawyer Dang Van Cuong, Head of Chinh Phap Law Office, Hanoi Bar Association, said: "Organizations and individuals selling fireworks from Z121 factory on social networks without permission from competent state agencies are not in accordance with the provisions of the law. Licensed business establishments must comply with safety regulations."
According to Mr. Cuong, the law currently does not prohibit businesses from advertising and selling on e-commerce platforms or social networking platforms, so licensed businesses are allowed to advertise and sell on electronic platforms. As for organizations and individuals who are not licensed to sell this type of fireworks, they are not allowed to advertise and sell fireworks on the internet.
In cases where organizations and individuals arbitrarily advertise, introduce, or sell firecrackers or fireworks, or sell fireworks without permission from a competent authority, this is a violation of the law.
Depending on the nature, severity of the violation and the consequences, the person committing this violation will be subject to administrative sanctions or criminal prosecution.
Mr. Cuong also recommends that consumers should not buy strange types of fireworks and firecrackers because using these types of firecrackers is also illegal.
According to the provisions of Article 10, Decree No. 167/2013/ND-CP of the Government stipulating administrative sanctions for violations in the fields of security, order, social safety; prevention and control of social evils; fire prevention and fighting; prevention and control of domestic violence, acts of illegally using firecrackers and fireworks that have not yet reached the level of criminal prosecution shall be subject to administrative sanctions with a fine of from 1 million VND to 2 million VND.
In addition, organizations and individuals who illegally produce, store, or transport fireworks or fireworks chemicals will be fined from VND5 million to VND10 million; in cases of illegally transporting fireworks into or out of Vietnam, they will be fined from VND20 million to VND40 million.
