Regional development and linkage policy in the Capital Law 2024

Kinhtedothi - The 2024 Capital Law stipulates a number of contents to specify the policy of linking and developing the Capital Region. In which, Hanoi is the center and driving force to promote linking and developing the region and the whole country.


Resolution No. 15-NQ/TW of the Politburo sets the goal for Hanoi to "develop rapidly, sustainably, and have a pervasive influence to promote the development of the Red River Delta, the key economic region of the North and the whole country" and identifies "developing the capital Hanoi into a cultured - civilized - modern city" as a particularly important political task in the strategy of building and defending the Fatherland with the spirit of "The whole country for Hanoi, Hanoi for the whole country".

Resolution No. 06-NQ/TW also identifies “building policies to strengthen linkages and coordination between the Capital and provinces in the Capital region in key areas of regional linkage to mobilize, use, and allocate all resources reasonably and effectively, aiming to build and develop the Capital region into a fast-growing, sustainable, green, civilized, and dynamic socio-economic region, becoming a key economic region of the whole country, removing policy obstacles to create motivation to mobilize investment capital for the Hanoi region and Ho Chi Minh City region”.

Institutionalizing the policies in the above Resolutions of the Party, the 2024 Capital Law specifically stipulates the following contents:

Objectives and principles of regional association and development (Article 44)

The 2024 Capital Law stipulates that the linkage and regional development of Hanoi is not only limited to the scope of 10 provinces and cities in the capital region as at present, but also includes linkage and development with other localities in the Red River Delta, the Northern midland and mountainous region and other provinces and cities.

The Law stipulates that Hanoi and the provinces and centrally-run cities in the Capital Region, the Red River Delta, the Northern Key Economic Zone, and the Northern Dynamic Zone are responsible for linking and developing according to programs and projects in accordance with the country's socio-economic development strategy and the national planning system. In particular, Hanoi is identified as the center and driving force for linking and development, and as the growth pole of the Capital Region, the Red River Delta, the Northern Key Economic Zone, the Northern Dynamic Zone, and the whole country (Clause 1, Article 44).

The Law stipulates four principles for regional development, including the principle of implementing coordination and association for development through plans, programs and projects for regional development approved by competent authorities and the principle of taking the lead in organizing the implementation of specific plans, programs and projects assigned to localities with tasks and powers related to or most affected by the fields and tasks requiring coordination and association (Clause 2, Article 44). These principles create the basis for establishing and operating a new, flexible regional development association model in the spirit of initiative and shared responsibility among localities in regional development association.

Regional development linkage programs and projects (Article 45)

The 2024 Capital Law defines regional development and linkage programs and projects as programs and projects implemented in two or more provinces or centrally-run cities, including Hanoi.

The Law does not specifically regulate the areas of regional linkage, but allows localities and relevant central agencies to take the initiative in proposing and implementing regional linkage and development programs and projects appropriate to the scale, nature and needs as well as the ability to participate and contribute of each locality.

Investment capital for regional development and linkage programs and projects (Article 46)

The Law stipulates that the central and local budgets are prioritized for the implementation of regional development cooperation programs and projects; the responsibilities of ministries, branches and localities participating in regional development cooperation programs and projects. Investment capital sources for regional development cooperation programs and projects in specific cases are as follows:

Regional development and linkage programs and projects using the state budget according to the list decided by the Prime Minister at the proposal of the City People's Committee (as the representative of the localities and after the Provincial People's Councils of the relevant localities have agreed and agreed to implement) and are given priority by the Central budget to allocate part or all of the budget, with priority given to the central budget's increased revenue source for the provinces in the regional linkage participating in the implementation of the program or project or the central budget is allocated with additional targets for the provincial People's Committee assigned as the competent authority to implement the program or project (Clause 1, 6, Article 46 and Clause 2, Article 45);

Programs and projects for regional linkage and development mobilizing ODA capital and preferential loans from foreign donors (Clause 2, Article 46);

Programs and projects for regional linkage and development using local budgets to support other localities (Clause 3, Article 46);

Programs and projects for linking and developing investment-calling regions of national investment promotion programs (Clause 4, Article 46);

Programs and projects for linking and developing investment areas entirely from non-state budget sources; in this case, programs and projects are entitled to investment incentives as prescribed in Article 43 of the 2024 Capital Law (Clause 5, Article 46).

Responsibilities of Ministries, branches and localities participating in regional development and linkage programs and projects (Article 47)

The 2024 Capital Law stipulates that in addition to equal responsibilities with other localities participating in regional development linkage programs and projects, the Hanoi City government is responsible for presiding over and coordinating the proposal and implementation of regional development linkage programs and projects in each field; the Ministry of Planning and Investment is responsible for presiding over and coordinating with localities, reporting to the Government to submit to the National Assembly to ensure budget balance for the implementation of regional development linkage programs and projects.

According to Dr. Architect Dao Ngoc Nghiem - Vice President of the Vietnam Urban Development Planning Association, when all regions develop, regional linkages will create favorable conditions for Hanoi to develop to its full potential as a Capital, a "Civilized - Cultural - Modern" City. To do this, there must be synchronous solutions: From raising awareness of the role of the Capital, promoting the potential and internal strengths of the Capital and especially innovating policy mechanisms, identifying the characteristics of the Capital, mobilizing development resources, managing urban development, urban reconstruction, decentralization, delegation of power... and the next step that needs to be implemented after the Capital Law 2024 comes into effect, the approved Master Plan is a proposal to adjust the Capital Regional Plan.
