Within the framework of monitoring the implementation of policies and laws on the promulgation of legal documents from January 1, 2019 to June 30, 2023 in Binh Thuan, Deputy Head of the Provincial National Assembly Delegation Nguyen Huu Thong, Head of the monitoring delegation of the Provincial National Assembly Delegation, had a working session with the Department of Natural Resources and Environment on the above content this morning, August 11. Attending were Ms. Thanh Thi Ky, Head of the Ethnic Committee of the Provincial People's Council; representatives of leaders of functional departments and branches.
The representative of the Department of Natural Resources and Environment (DONRE) reported to the Monitoring Team that during the above period, the legal documents (QPPL) in the field of natural resources and environment were advised by the DONRE to the People's Council and People's Committee to be issued in accordance with the provisions of the law and guiding decrees; creating a legal corridor to ensure effective state management in the field of natural resources and environment in the province. Specifically, the department advised on the timely issuance of 9 legal documents related to the field of state management. For example, regulations on collection rates, collection, payment and management of fees for granting certificates of land use rights, house ownership rights and assets attached to land; fees for appraising dossiers for granting certificates of land use rights; regulations on state management of minerals in the province... However, there are still 6 documents that have not been advised by the department to issue detailed regulations, including 4 documents related to solid waste management. The reason is that the Ministry of Natural Resources and Environment has not yet issued a number of documents providing detailed guidance on a number of contents assigned in the Law on Environmental Protection; therefore, the Department does not have enough legal basis to advise the Provincial People's Committee.
The Department of Natural Resources and Environment also made recommendations to the Monitoring Team to request the National Assembly, the Government, and central ministries and branches to promptly issue the Marine Spatial Planning, the Master Plan for the Exploitation and Sustainable Use of Coastal Resources, and the Program for Integrated Coastal Resources Management so that coastal localities can develop orientations for marine economic development. The central government should promptly issue the revised Land Law, Mineral Law, Water Resources Law, and documents guiding the implementation of the law in accordance with the current situation. The Ministry of Natural Resources and Environment should promptly issue detailed guidance documents in the Law on Environmental Protection related to solid and domestic waste management as a basis for detailed regulations.
At the monitoring session, delegates participated in giving comments and suggested that the Department of Natural Resources and Environment advise the Provincial People's Committee to consider amending some articles of Decision No. 21 of the previous People's Committee to be suitable for the division of plots, agricultural land in residential areas, and the management of small-scale land in residential areas, in accordance with current reality.
In his concluding remarks, Deputy Head of the Provincial National Assembly Delegation Nguyen Huu Thong acknowledged and highly appreciated the achievements of the Department of Natural Resources and Environment in implementing policies and laws on the promulgation of legal documents in the field of natural resources and environment. At the same time, the Head of the Supervisory Delegation emphasized the important role of promulgating legal documents in the field of natural resources and environment in state management in the province. He requested the Department to continue directing its departments and units to perform well in drafting legal documents, providing timely advice on documents; focusing on checking, processing, reviewing and systematizing legal documents; unifying the viewpoint of advising documents for the province related to the Land Law, ensuring people's rights. Regarding the Department's recommendations, the Provincial National Assembly Delegation will synthesize and report to the 15th National Assembly at the next session.
