Need special policies to preserve and promote rare cultural heritage

The Draft Law stipulates activities of managing, protecting and promoting the value of cultural heritage; rights, obligations and responsibilities of agencies, organizations, communities and individuals in protecting cultural heritage in the Socialist Republic of Vietnam.

Cultural heritage prescribed in this Law includes intangible cultural heritage, tangible cultural heritage and documentary heritage, which are spiritual and material products of historical, cultural and scientific value, passed down from generation to generation in the Socialist Republic of Vietnam.

Improve the effectiveness and efficiency of management, protection and promotion of cultural heritage values

Presenting a report at the meeting, Minister of Culture, Sports and Tourism Nguyen Van Hung stated that the law is aimed at creating favorable conditions for activities, improving the effectiveness and efficiency of state management, promoting the application of information technology, digital transformation, service activities, public-private partnership in the field of cultural heritage..., while ensuring harmony between conservation and development.

The draft Law on Cultural Heritage (amended) focuses on 3 main groups in the law-making proposal approved by the Government, including:

Policy 1 on perfecting regulations on principles, subjects, procedures, inventory, identification, registration, measures for management, protection and promotion of cultural heritage values ​​in the fields of tangible cultural heritage (relics; artifacts, antiquities, national treasures), intangible cultural heritage, documentary heritage and museum activities;

Policy 2 on improving the effectiveness of organization and operation of agencies directly managing heritage, enhancing the content, responsibility, and implementation mechanism of decentralization and delegation of state management of cultural heritage from the central to local levels;

Policy 3 on strengthening the content, mechanisms and policies to promote socialization and attract, improve the efficiency of mobilizing resources to protect and promote the value of cultural heritage.

In the preliminary review report of the draft Law, Chairman of the National Assembly's Committee on Culture and Education Nguyen Dac Vinh said that the Standing Committee of the Committee agreed with the necessity of comprehensively amending the 2001 Law on Cultural Heritage (amended and supplemented in 2009) to continue institutionalizing the Party's viewpoints and policies, overcoming difficulties and obstacles, resolving arising issues, and improving the effectiveness and efficiency of management, protection and promotion of cultural heritage values.

At the same time, focus on reviewing policies, especially policies on investment and State support; socialization policies, application of science and technology, digital transformation, human resource development... to ensure specificity, transparency, efficiency, feasibility, and consistency in the legal system...

Regarding the content of public-private partnership in the protection and promotion of cultural heritage values, the Standing Committee of the Committee found that regulations on public-private partnership in the protection and promotion of cultural heritage values ​​are necessary, but it is necessary to study and amend and supplement the provisions of the Investment Law in the form of public-private partnership, ensuring suitability, completeness, consistency and feasibility.

Preserving and promoting the value of cultural heritage with the spirit of development and creation

Speaking at the meeting, National Assembly Chairman Vuong Dinh Hue acknowledged that the draft Law was carefully and seriously drafted, with basic content institutionalizing the Party's policy on culture and cultural heritage in particular, especially after summarizing 80 years and the elaborately organized Cultural Conference and Cultural Forum.

The National Assembly Chairman said that the draft law is now eligible to be submitted to the National Assembly at its upcoming 7th session; expressing his hope that it will create fundamental changes in the management and promotion of cultural heritage values.

Basically agreeing with the contents of the review and comments on the State policy on cultural heritage in Article 7 of the draft Law, the National Assembly Chairman emphasized that cultural heritage should be considered a resource for development, should be preserved and promoted; the relationship between preservation and promotion should be reviewed in the overall legal document, with the spirit of development creation.

The National Assembly Chairman requested the Drafting Committee to study, consider and supplement policies and strategies on cultural industry, cultural market, digital cultural transformation, digitalization of cultural heritage, public-private partnership, cultural economy, etc. At the same time, study and supplement a number of specific policies and strategies to preserve and promote the cultural heritage of ethnic minorities, mountainous areas, islands, and rare cultural heritage at risk of being lost, etc.

Regarding the structure and content, the National Assembly Chairman raised the issue of whether it is necessary to separate a chapter (Chapter 4 of the draft Law) on protecting and promoting the value of documents, because documentary heritage is tangible cultural heritage such as relics, antiquities, national treasures... currently preserved and stored in museums, libraries, archives centers and stored in places associated with relics such as temples, pagodas, communal houses...

According to the National Assembly Chairman, these heritages already have regulations and management processes; if there were a separate chapter regulating them, it would overlap with other regulations. Therefore, the National Assembly Chairman suggested considering stipulating them in Chapter 3 of the draft Law on the protection and promotion of intangible cultural heritage; at the same time, the concept of “artifacts of special value” should be added to the explanation of the term.

To continue perfecting the draft law, the National Assembly Chairman requested that agencies continue to review to ensure compatibility and consistency with laws in the legal system such as the Investment Law, Public Investment Law, Land Law, Law on Religious Beliefs, Law on Environmental Protection, Law on Investment under the public-private partnership model, etc.
